Levin Powell in the plea af.d    Whereupon at the request of the parties af.d
day is to them ^here^ given to ^be^ before his Lordships Justices at the next Court to be held at
deviding Creek in and for the County af.d the third tuesday of March then next
following in the same state as at present saving to the parties af.d &.a

    Att which day here Came againe the parties af.d by their attorneys af.d and
the af.d Levin Powell who offered the writt af.d against the af.d John in the af.d
plea af.d doth not further prosecute the same Writt      Therefore he and his
pledges of prosecuting be in Mercy and let the plantiffe name pledges &.a
and that the af.d John Lamberson goe thereof without day  Also it is Considered
that the af.d John Lamberson recover against the af.d Levin Powell his
damages by occasion of the premisses to:
164                                       :pounds of tobacco to the same John by discretion
of the Justices hereat his request for his Costs and Charges in that part sustained
according to the form of the statute thereof made and provided by the Court
here adjudged &.a
