    Command was given to the Sheriffe of Somerset County that he Should take
Thomas Collins and Nehemiah Holland both of Somerset County planters if they
should be found in his bailywick  And them should safe keep so that he might
have their bodys before the Justices of his Lordships County Court of Somerset to be held at deviding
Creek in the same County the third tuesday of June Anno Dom one thousand seven
hundred and thirty seven to answer unto John Lay of a plea of trespass upon the Case
&.a ^and the same day is given to the afd John here &a^    Att which day here before his Lordships Justices at a Court then held at deviding
Creek in the same County Came the af.d John Lay by Francis Allen his attorney
and the af.d sherriffe to witt John Henry Gent now here returned that he had
taken the af.d Thomas Collins and Nehemiah Holland whose body here at this day
he had ready to answer the af.d John Lay of the af.d plea as to him it was Commanded
       and whereupon the afd Thomas Collins and Nehemiah Holland puts in their place Geo:
Douglas Gent against the afd John Lay in the plea afd      Whereupon at the request of the parties afd
day is to them here given to be before his Lordships Justices at the next Court to be held at dividing Creek
in and for the County afd the third Tuesday of August the next following in the same state ^as at present^ saving to the parties
&.a      Att which day here Came againe as well the afd John Lay as the afd Thomas Collins and Nehemiah
Holland by their attorneys afd  And whereupon the said John Lay declared against the afd
Thomas Collins and Nehemiah Holland in the plea afd in form following   Somerset County ss  Thomas
Collins and Nehemiah Holland late of Somerset County planters were attached to answer
unto John Lay of a plea of trespass upon the Case &a

And Whereupon the said John by Francis Allen his attorney complains that
whereas on the fourteenth day of November Anno Dom seventeen hundred
and thirty six at the County of Somerset af.d within the Jurisdiction of this Court
a Certain Communication being had and moved between the said Thomas Collins
and Nehemiah Holland and the af.d John Lay Concerning two suits by the said
John Lay commenced against the said Thomas and then depending in Somerset
County Court on the behalf of the said John against the said Thomas for two
severall assaults and batterys committed by the said Thomas upon him the
said John before that time the said Thomas and Nehemiah in Consideration
that he the said John at the speciall Instance and request of the said Thomas
and Nehemiah would not further prosecute the said suits against him the said
Thomas the day and year af.d at the County af.d upon themselves did assume and to
