230 of his Lordships County Court of Somerset to be held at dividing Creek in the same County the third Tuesday of June Ann Dom One thousand Seven hundred and thirty Seven to answer unto William Draper of a plea of trespass upon the Case &a and the Same day is given to the afd William Draper here &a Att which day here before his Lordships Justices at a Court then held at deviding Creek Came the af.d William Draper by George Douglas his attorney and the af.d sherriffe to ^witt^ Joseph Macclester Gent now here returned that he had taken the af.d Frances Bowger whose body hereat this day he had ready to answer the af.d William Draper of the af.d plea as to him it was Commanded Whereupon Came hereinto Court Joseph MccClester Late of Somerset County Gent in his proper person and undertook for the same Francis Bowger and assumed upon himself that if it should happen that Judgment in the plea afd should be rendred for the same William Draper against her the same said Frances Bowger or that the said Frances should be therein Convict that then she the said Frances should pay and satisfie unto the same William the Judgment of the Court thereupon or render her body in execution of such Judgment to the prison of the sherriffe of the County af.d in satisfaction thereof or that he the same Joseph Macclester will do the same for her And afterwards the same day Came here as well the afd William Draper by his attorney afd as the afd Frances Bowger by Francis Allen her attry and Whereupon at the prayer of the ^same^ parties day is given to them before his Lordships Justices at the next Court to be held at dividing Creek in and for the County afd the third Tuesday of August Ann Dom Seventeen hundred and thirty Seven to be in the same State as at present saving to the parties afd & a
And hereupon the aforesaidWilliam Draper declared against the afd Frances Bowger in the plea afd in form following Somerset ss Frances Bowger Late of Somerset County Spinster was attached to answer unto William Draper of a plea of trespass upon the Case &a And Whereupon the said William by George Douglas his attorney complains that whereas the said Frances after the first day of may Anno Dom MDCCV to witt on the sixth day of November Anno Dom MDCCXXXVj at Somerset |
