his writt and declaration aforesaid against the afd Ann Draper did not prosecute with Effect but voluntarily permitted
his suit to be discontinued
                                                          Therefore afterwards to witt that Same day by discretion of his Lordships
Justices here before the same Justices were adjudged to the Same Ann Draper Executrix as afd
555                                                          pounds of tobacco for her Costs and Charges by her about her defence in
that part sustained according to the form of the Statute in such Case thereof made and provided and the afd John
in Mercy & that the afd Ann have thereof Execution &c

    Command was given to the sheriff of Somerset Count that he should take
John Britt late of Somerset County planter if he should be found in his bailywick
and him ^should^ safe keep so that he might have his body before the Justices of his Lordships
County Court of Somerset to be held in the Court house at dividing Creek in the same
County the third tuesday of June Anno Dom seventeen hundred and thirty six to answer unto
Thomas Fletcher of a plea of trespass upon the Case &c  and that thereof he Should not fail &c

    Att which day here Cometh the afd Thomas Fletcher by Francis Allen his attorney and the Sheriff of the
County afd to witt Joseph Macclester Gent at the same day returned that he had taken the afd John
Britt and him held there ready according to the Exigence of the writt afd

    Whereupon the Said John Britt present here in Court in his proper person at the prayer of the
same Thomas Fletcher by his attorney afd is adjudged by the Same Court to give Speciall bail to the
action afd but for want thereof the same John Britt is Committed in to the Custody of the Sheriffe
of Somerset County afd there to remain untill the third Tuesday of August then next following & the
same day is Given to the afd Thos Fletcher there &c

    Att which day here Came againe as well the afd Thomas Fletcher by his attorney afd as the afd
John Britt in Custody of the Same Sher in his proper person and thereupon the Same John Britt is
againe Committed ^by the Court here^ into the Custody of the Sheriffe afd for the Cause afd there to remain untill the third
Tuesday of November then next following and the same day is given to the afd Thomas Fletcher there &c

       Att which day here Came againe as well the afd Thomas Fletcher by his attorney afd as the afd
John Britt in Custody of Sheriffe afd in his proper person and thereupon the said John Britt by
the order & direction of the same Thomas Fletcher is discharged from the Commitment afd and from
out of the Custody of the afd Sheriffe &c   And hereupon the said Thomas by his attorney
afd declared against the the afd John Britt in the plea aforesaid in form following
