the same John in this part Craftily and subtilly to deceive and defraud the af.d six pounds
paper money or any part thereof to the same John hath not as yet paid or him for the
same in any sort contented altho' the same to do the af.d William afterwards (to witt)
the same day and year last af.d at the County af.d and often since that time by the same John
saith he is the worse and hath damage to the value of ten pounds Currt money of maryland
and thereof he brings suit &.a                        Pledges &.a  John Doe & Richard Roe

A Copy of the foregoing decleration was made and sent to be served with the writt af.d on the
deft according to act of assembly in such case provided   Att which day here before his
Lordships Justices in Court then held at deviding Creek in the County af.d Came the af.d
John Caldwell by his attorney af.d and the sherriffe to witt John Henry Gent now here
returned that he had taken the af.d William Gray whose body hereat this day he had
ready to answer the af.d  John Caldwell of the af.d  plea as to him it was Commanded and
further the same sheriffe returned that he had served the same William Gray with a Copy
of the declaration af.d according to act of assembly in such case made and provided &a

                   And the afd William Gray by Francis Allen his attorney Cometh and defendeth
the force and Injury when &.a and Saith that he Cannot deny the action aforesaid of the aforesaid
John Caldwell nor but that he did assume upon himselfe in manner and form as the afd John above
against him hath Complained and as to the damage of the Same John by him by Occasion of the
premisses in that part Sustained the Same William saith and acknowledgeth that the afd John hath
Sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit in that
part apposed to six pounds paper money and not more and because the afd John Denys not this but the
same allegation believes to be true prays Judgm.t for those damages above acknowledged together with his Costs
and Charges afd to him to be adjudged &a
                                                                            Therefore by Consent of the parties afd it is Considered
that the afd John Caldwell Recover against the afd W.m Gray his damages afd to the afd Six pounds in
4622    paper money by the same William in form afd Acknowledged as also
462                                                      pounds of tobacco for his Costs and Charges afd to the Same John
at his request by the Court now here of the assent of the parties afd adjudged which Certain damages amounts
in the whole to six pounds paper money and                                                                              pounds
of tobacco and the afd William Gray in mercy &a
