151 paid or him for the same in any sort contented altho' the same to do the af.d John afterwards (to witt) the same day and year af.d at the County af.d and often since that time by the same James he was thereunto requested but the same to him hetherto to pay or him for the same in any sort to Content he hath altogether refused and still doth refuse Whereupon the same James saith he is the worse and hath damage to the value of ten pounds Curr.t money of maryland and thereof he brings suit &a Pledges &a J Doe & R Roe Att which day here before the Justices of his Lordships County Court of Somerset take held at deviding Creek Came the af.d James Mumford by his attorney af.d and the sherriffe to witt John Henry Gent at the same day here returned that he had taken the af.d John Small whose body hereat this day he had ready to answer unto unto the af.d James Mumford ^of^ the af.d plea as to him it was Commanded And whereupon the afd John Small in his proper person Comes and defends the force and Injury when &.a and Saith that he Cannot Gainsay the action afd of the afd James Mumford nor but that he did assume upon himselfe in manner and form as the afd James Mumford above against ^him^ hath Complained and as to the damage of the Same James by him by Occasion of the premisses in that part Sustained the same to four pounds Seven Shillings and Six pence Curr.t money of Maryland and not more & because the afd James denys not this but the same allegation beleives to be true prays Judgment for those damages above acknowledged together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered that the afd James Mumford recover against the afd John Small his damages afd to the afd four pounds Seven Shillings and Six pence Curr.t money of Maryland in form afd acknowledged as also Two hundred Eighty and Nine pounds of tobacco for his Costs and Charges afd to the James Mumford at his request by the Court now here of the assent of the parties afd adjudged which Certain damages in the whole do amount to four pounds Seven Shillings and Six pence Curr.t Money of Maryland and Two hundred Eighty and Nine pounds of tobacco and the afd John Small in Mercy &a (Bail peice should been Entered Immediately after return of the writ) Whereupon Came hereinto Court a Certain John Henderson |
