148 and seven at Somerset County af.d within the Jurisdiction of this Court did make his certain note in writing called a promisary note with his proper hand subscribed bearing date the same day and year last mentioned and the note af.d to the said Martin Fenton then and there delivered by which said note the same Wonney M.ccClemmey did oblidge himself his heirs or executors to pay or Cause to be paid to the said Martin Fenton the full and just sum of ten pounds paper money for value received and by reason thereof as also by vertue of the statute in that case lately made and provided the same Wonney M.ccClammey became chargeable to pay to the said Martin Fenton the said ten pounds according to the tenor of the said note and so there with chargeable being the af.d Wonney M.ccClammey afterwards (to witt) the af.d second day of August in the year of our Lord God one thousand seven hundred thirty and seven af.d within the Jurisdiction af.d upon himself did assume and to the same Martin Fenton then and there did faithfully promise to pay the sum of money af.d according to the tenor of the said note Nevertheless the said Wonney M.ccCleammey his promise and assumption af.d in form af.d made nothing regarding but plotting and fraudulently intending the said Martin Fenton in that part craftilly and subtilly to deceive and defraud the af.d ten pounds to the same Martin Fenton he hath in no sort paid or satisfied altho' the same to do the said Wonney M.ccClemmey by the said Martin Fenton (to witt) on the eighteenth day of August in the year last above mentioned and often afterwards at Somerset County af.d he was thereunto requested but the same to the said Martin Fenton to pay or him for the same in any sort to Content and satisfie hath refused and still doth refuse Whereupon the said Martin Fenton saith he is the worse and ^hath^ damage to the value of twenty pounds Curr.t money of maryland and thereupon he brings suit &.a Pledges &.a J Doe & R Roe Att which day here before the Justices of his Lordship County Court of Somerset at deviding Creek Came the af.d Martin Fenton by his attorney af.d and the sherriffe to witt John Henry Gent at the same day here returned that he had taken the af.d Wonney M.ccClemmey whose body hereat this day he had ready to answer unto the af.d Martin Fenton of the ^afd^ plea as to him it was Commanded and the same sherriffe further returned that he had served the same Wonney M.ccClammey with a Copy of the declaration af.d according to the act of assembly in such case made and provided &.a Whereupon |
