12 Seven pence with two hundred & twenty pounds of tobacco as wittness our hands this 15 day of February 1736 Thomas Wallace John Tamplin Benjamin Tull Edmd Hough Whereupon Came here into Court the afd James Rownd by his attorney afd before the Justices of his Lordships County Court of Somerset now here held in the Court hous at Dividing Creek in the Same County and prays that the afd Twelve hundred pounds of tobacco & Fourteen Barrells From Bushells one peck & a halfe of Indian Corn of the Value of five pounds Eleven Shillings & Seven pence Curr.t money so as afd attached upon Giving Security according to act of assembly in Such Case provided may be Condemned in his hands as of the goods and Chattells of the said John Cutler towards Satisfiying unto him his Damages and Costs & Charges by reason of the attachment afd and the said John Cutler at the Same day altho Solemnly Called Came not nor Shews Cause why the same Should not be Condemned &c Thereupon a Certain Robert Jenckins Henry of Somerset County Gent present herein Court in his proper person undertakes for the said James Rownd according to act of assembly that in Case the said John Cutler do at any time within a year & a day appear and make all or any part of the said James Rownds Claim against him appear to be satisfied or Other Wise to be undue before the Laying of this attachment that then the said James Rownd shall make restitution unto him the said John Cutler of all or Such part thereof as shall be so made appear to be undue &c or that he the said Robert Jenckins Henry will do it for him &c Therefore it is Considered that the afd Twelve hundred pounds of tobacco and Fourteen Barrells Four bushells and one peck and halfe peck of Indian Corn of the Value of Five pounds Eleven Shillings and Seven pence Curr.t money of Maryland so as afd attached be Condemned in the hands of the afd Edmond Hough as of the goods and Chattells of the afd John Cutler towards satisfying unto him his damages and Costs and Charges by reason of the attachm.t af.d & that he have thereof Ex.n &c
And Whereupon the said Joshua by George Douglas his attorney complaines that Whereas the af.d Joseph on the tenth day of May Anno Dom seventeen hundred and thirty five at Somerset County af.d within the Jurisdiction of this Court was Indebted to the said Joshua in the sum four thousand three hundred and two pounds of tobacco for sundry matters and things properly lying in account as by an account thereof herewith into Court brought and hereto annexed may appear and being so thereof Indebted on Consideration thereof upon himself did assume and |
