12 was Issued the attachment following against the rights or Credits of the said John Cutler &c Somerset ss.t Charles absolute Lord and proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &.c To the sheriff of Somerset County Greeting we Comand you that you attach any the goods chattles Rights or Creditts of John Cutler late of Somerset County planter if they shall be found in your bailywick to the value of ten pounds Curr.t five shillings and four pence half penny Curr.t money and five hundred pounds of tobacco and when you have the same attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of march Next then and there to be Condemned According to Act of assembly to and for the use of a Certain James Rownd unless the said John Cutler by himself or his attorney shall appear and answer unto the said James Rownd in a plea of trespass upon the Case &c According to Law and that by good and Lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as af.d to shew caus if any he she or they have why the same Goods Chattles Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made (According to Act of assembly in such case mad^e^ and provided) if to him her or them it shall seem meet and how you shall Execute this Writt that you make known unto our said Justices at the day and place af.d and have you then and there this Writt Wittness Rob.t King Gen.t Chief Justice of our said Court the twenty fourth day of November Anno Dom one thousand seven hundred and thirty six Att which said third Tuesday of March to witt the fifteenth day of the same month anno Dom One thousand Seven hundred and thirty Six being the day of the return of the said Cometh the said James ^Rownd^ by Robert Jenckins Henry his attorney and the Sheriff of Somerset County to whom the foregoing writt was directed Likewise Comes and makes return thereof to the Court in these words following vizt By vertue of the within writt to me directed to the Justices within Mentioned I Certifie that I have attached of the goods and Chattells of John Cutler for the Use of James Rownd twelve hundred pounds of tobacco and Corn to the value of five pounds eleven Shillings and seven pence which further appears by Schedule hereunto annexed & I further Certifie that by John Doe & richard Roe good & Lawfull men of my bailywick that I have made known unto the within named James Rownd that he be and appear at the same time & place &c 1200ll of tobacco To 14 Barr.lls 4 Bushells 1 peck and an half Corn valued at £5..11..7 We the Subscribers whose names are under written being duly Sworn on the holy Evangelist of almighty God to appraise the Goods and Chattells of John Cuttler that should Come to our view for the Use of James Rownd upon our Oath do say that the above Corn is valued by us to five pounds Eleven Shillings and seven |
