121 Tuesday of November ann Dom One thousand seven hundred and thirty six to answer unto Thomas Adams of a plea wherefore he the Same John with force and arms in and upon the afd Tho.s Adams at Somerset County afd in the peace of God and of the Right honourable the Lord proprietary that now is an assault did make and him the said Thomas Adams did beat wound and Evilly treat so that of his Life it was greatly despaired and other harms to him did to the great damage of the same Tho.s Adams and against the peace of the said Lord Proprietary &.c and that thereof he should not fail &c Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the said Thomas Adams by William Goldsborough his attorney and the ^afd^ Sheriffe to witt Joseph Macclester Gent at the same day here returned that he had taken the afd John Deal whose body here at this day he had ready to answer unto the afd Thomas Adams of the afd plea as to him it was Commanded And hereupon the afd Thomas Adams declared against the afd John Deal in the plea afd in form following Somerset ss John Deal late of Somerset County planter was attached to answer unto Thomas Adams of a plea wherefore with force and arms in and upon the af.d Thomas Adams at Somerset County af.d in the peace of God and of the Right Honourable the Lord proprietary that now is an assault did make and him the said Thomas Adams did beat wound and Evilly treat so that of his life it was greatly despaired and other harms to him did to the great damage of the same Thomas Adams and against the peace of the said Lord proprietary &.c And Whereupon the same Thomas by William Gouldsborough his attorney complaineth that the af.d John on the second day of August in the year of our Lord God seventeen hundred thirty and five with force and arms to wit with sticks Clubs and fists at Somerset County af.d within the Jurisdiction of this Court in and upon him the same Thomas in the peace of God and of the Right Honourable the Lord proprietary that now is an assault did make and him the Thomas then and there did beat wound and evilly treat so that of his life it was greatly despaired and other harms to him then and there did to the great damage of the said Thomas and against the peace of the said Lord proprietary &c wherefore he saith that he is the worse and damage hath to the value of three thousand pounds of tobacco and thereupon he brings suit &c Pledges &c Jn.o Doe & R Roe And the afd John Deal by George Douglas his attorney Cometh and defendeth the force and Injury when &.c and prayeth Leave thereof to Imparle hereuntill the third Tuesday of March then next following and he hath it and the Same day is given to the afd Thomas Adams here also &c Att which day here Came againe as well the afd Thomas Adams as the afd John Deal by their attorneys afd and whereupon the same John Deal prays further Leave thereof to Imparle here |
