83 Anderson will do the same for him &a Whereupon the Same John Hendry by Francis Allen his attorney Cometh and defendeth the force and Injury when &a and saith that he Cannot gainsay the action afd of the afd Joseph Miller nor can he say but that he Owes the afd Joseph Miller the afd Eight pounds ten shillings Curr.t money of Philedelphia of the Value of Eight pounds ten Shillings Curr.t money of Maryland in manner & form as the Same Joseph above against him hath Declared wherefore the Said Joseph prays Judgmt for his debt aforesaid and his damages Sustained by Occasion of the detaining of that Same debt to him to be adjudged &a Therefore it is Considered by the Court here that the afd Joseph Miller Recover against the afd John Hendry his debt aforesaid and his damages Sustained by Occasion of the detaining of that Same 253 debt to pounds of tobacco to the Same Joseph Miller by the Court hereof his assent adjudged and the afd John Hendry in Mercy &a I the Subscriber doe hereby Certifie that Littleton Townsend and James Anderson have been quallified as Subsheriffs (under Cap.t Joseph M.cClester by taking y.e Oaths appointed by act of assembly to the government & Oath of undersheriff & Subscribing the Oath of Abjuration & test) before me this 23.d of August Ann Dom 1735 Wm Lane
at dividing Creek were adjudged for his damages which he Sustained by occasion of ^a Certain^ trespass upon the Case to the same John by the aforesaid Thomas in the County afd made and brought whereof he is Convict and that he should have that same money and tobacco before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August then next to satisfie the afd Thomas Fletcher of his damages afd and that thereof he should not fail &a Att which said third Tuesday of August to witt the Ninteenth day of the same month Ann Dom One thousand Seven hundred and thirty five came the said Thomas Fletcher in his own proper person and the Sheriff of Somerset County to whom the foregoing writt was directed Likewise cometh and maketh return thereof to the Court here Endorsed in these words Following Viz.t I do hereby Certifie that by vertue of the within writt to me directed I have made and levied of the goods and Chattells of the within named John Aydelott Seven pounds Eight Shillings and Seven pence half penny Current money of Maryland and Seven hundred and fifty one pounds of Tobacco which I have herein Court ready as by the within writt I am Commanded Jos: M.cClester Sher |
