78 Charges to one pound of tobacco Therefore it is Considered by the Court here that the afd Solomon Heatch recover against the said James Parramore his damages aforesaid ^by the Jurors afd^ in form aforesaid 1337 assessed as also thirteen hundred Eighty two pounds of tobacco for his Costs and Charges aforesaid to the Same Solomon Heatch by the Court here of his assent of Increas adjudged which Certain damages in the whole do amount to three pounds Curr.t money of Maryland and pounds of tobacco and the afd defend.t in Mercy &a
Dom Seventeen hundred and twenty three at the County of Somerset afores.d within the Jur of this Court was possessed of one Copper Still of the Value of Fifteen pounds Curr.t money of Maryland one pewter worm for the still & a Tubb belonging to it of the value of three pounds like money one Silver headed Cane of the value of Forty Shillings like money one Surveyors Compass Chain Staves & Seale & dividers all of the value of Seven pounds like money as of his proper goods & Chattles and so being of the same possessed the s.d Goods & Chattles afterwards to witt on the sixth day of March Ann Dom Seventeen hundred & thirty Four at Somrsett County afores.d to the hands & possession of the s.d Benjamin by finding came Nevertheless the s.d Benjamin well knowing the goods & Chattles afores.d to be the proper goods & Chattles of the s.d James and to him the s.d James of right to belong & appertain plotting & fraudulently intending the s.d James of the goods & Chattles afores.d craftilly & Subtilly to deceive & defraud the goods & Chattles afores.d tho' often requested to y.e afores.d James hath not delivered but the goods & Chattles afores.d afterwards to witt on the twenty Sixth day of May Ann Dom Seventeen hundred & thirty Five at the County of Somerset aforesaid to his own proper use did Convert & dispose to the damage of the s.d James of Fifty four pounds Curr.t money of Maryland and thereupon he brings Suite &.a Pledges &.a John Doe & R Roe And the afd Benjamin Venables by George Douglas his attorney cometh and defendeth the force and Injury when &.a and prays leave thereof to Imparle hereuntill next Court and he hath it & the same day is given to the af.d James herealso &.a Att which said next Court to witt the Nineteenth day of August Ann Dom one thousand seven hundred thirty and five came again as well the af.d James Givan as the af.d Benjamin Venables by their attorneys af.d And whereupon the same Benjamin Venables as before defends the force & Injury (when &a |
