at the County of Somerset within the Jurisdiction of this Court was possessed of one bay horse of the price of fifteen pounds Curr.t money of Maryland ^&^ one Sorrell Mare of the price of Nine pounds Current money of Maryland & of one Sorrell Mare yearling of the price of five pounds Current money of Maryland as of his proper Goods & Chattles & being so thereof possessed the said Goods & Chattles out of his hands & possession casually lost which said Goods & Chattles afterwards to wit on the said twelfth day of May in the year af.d at the County af.d to the hands & possession of the said James Parremore by finding came Nevertheless the said James well knowing the goods & Chattles af.d to be the proper Goods & Chattles of the said Solomon & to him the said Solomon of right to belong & appertain plotting & fraudulently the said Solomon of the goods & Chattles afores.d craftily & Subtilly to deceive & defraud the goods & Chattles af.d tho' often requested to the af.d Solomon hath not delivered but the goods & Chattles af.d afterwards to witt the thirteenth day of May afores.d in the year aforesaid at the County af.d to his own proper use did Convert & dispose to the damage of the said Solomon Heatch forty pounds Current money of Maryland & thereof he brings Suite &.a pledges &a Jn.o Doe R Roe And the af.d James Parremore by George Douglas his attorney comes and defends the force and Injury when &a and prays leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d Solomon herealso &.a Att which said next Court to witt the Nineteenth day of August ^Ann Dom^ One thousand Seven hundred and thirty five came againe as well the af.d Solomon Heatch as the af.d James Parremore by their attorneys af.d and whereupon the same James Parremore as before defends the force and Injury when &.a and says that he is not Guilty of the premisses above upon ^him^ imposed in manner & form as the said Solomon above against him hath Complained of this he putts himself upon the Country and the said Solomon in like Manner Thereupon it is Commanded the Sheriff of Somerset County that Immediatly he should Cause to come here before the Justices of his Lordships County Court of Somerset now sitting at dividing Creek in the County af.d twelve &.a by whome &.a and who neither &.a to recognize &.a because as well &.a and afterwards Immediatly came thereof the Jury &.a and the Jurors of that same Jury by Joseph M.aClester Gent Sheriff of the County af.d to this Impannelled being called came to witt William Holland, Lewis Jones, Joshua Caldwell, Robert Mitchell, Philip Quinton, Joseph Houston, John Records, Nathaniell Crapper, Benjamin Tull, John Townsend Jnr, Thomas Ackworth, and John Pope, who to say the truth in the premisses aforesaid being duely Elected tryed and Sworn upon their Oath do say that the said James Parramore is Guilty of the premises afd in manner and form as the said Solomon Heatch above against him hath Complained and assessed the damages of the Same Solomon by Occasion of the premisses afd beyound his Costs and Charges by him about his Suit in that part apposed to three pounds Curr.t money of Maryland and for those Costs and Charges |
