(70) God according to act of assembly in such Case made and provided) and there Cause to come before you or any three or two of you all such Evidences as shall be to you or any three or two of you Nominated by the said Complainent or def.t if any and that you or any three or two of you Examine them upon their Corporall oaths to be by your or any three or two of you administred on the holy Evangelist of Almighty God in the presents of the Complainent or Def.t if any touching the truth or rememberance of their knowledge or any thing that may relate to the Cause afores.d and that reducing the Severall depositions into writing you send the same together with this our Commission under your or any three or two of your hands and Seals to us to our County Court of Somerset with all Convenient Speed Wittness Robert King Gent Chief Justice of our said Court the twentieth day of March in the Nineteenth Year of our Dominion &.a Ann Dom One thousand Seven hundred and thirty three On the backside of the foregoing Commission it was Endorsed as Followeth Viz.t July y.e 22.d day 1734 was M.r Day Scott and Joseph Wailes sworn on y.e holy Evangelist of Almighty God to Execute y.e within Commission before me James Dashiell The Execution of the within Commission appears by the deposition hereunto annext Likewise the foregoing Commission was annexed the following Day Scott deposition Viz.t Joseph Wailes The deposition of M.r Thomas Dashiell Sen.r aged Sixty nine years or there abouts being Sworn on the holy Evangelist of Almighty God saith that as he was riding to his brother George Dashiells who lived at Quantico he saw a red oak newly markt and some short time after he and his brother James Dashiell had some talk about that tree and this deponant saith that his brother James Dashiell told him it was his second bounder of a tract of land called Anything and this deponant declareth to the best of his knowledge that this is the very oak (which oak stands about a quarter of a mile of the main road that leads from Wiccomico ferry to Nanticoke ferry on the right hand of a Small path that goes along a ridge where Dan.l Sheridon formerly lived) and further this deponant saith not We the Subscribers two of the Commissioners in the Commission above mentioned did meet on the abovesaid land called any thing we being first quallified according to law and having Sumoned and Sworn the within wittnesses took his deposition in as within Specefied In Testimony whereof we have hereunto affixed our hands and Seals as by the Commission within ^we^ were required Day Scott (seal) Joseph Wailes (seal)
