6 Ordered by the Court that Thomas Toadvine and Jonathan Shockley recover against Henry Toadvine ninty pounds of tobacco each being due unto them for their attendance three days each as evidences on behalfe of the said Henry Toadvine against Isaac Handy they and each of them having made oath to the same &.a Ordered by the Court that Henry Lawrence and Wrixham Crapper recover against Benjamin Tull sixty pounds of tobacco Each it being due unto them for their attendance two days Each as Evidences on behalfe of the said Benjamin Tull against William Teague they and Each of them having made Oath to the same &.z Ordered ^by the Court^ that Thomas Hearn recover against Joshua Caldwell ninty pounds of tobacco being due unto him for his attendance three days as an Evidence on behalfe of the Said Joshua Caldwell against Tho.s Holbrook he having made Oath to the same &a
before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of november then next to answer unto John Maglaughlin administrator of all and Singular the goods and Chattells Rights and Creditts which were of Mary Magraw late of the same County decd at the time of her death who died intestate as 'tis said of a plea of trespass upon the Case &.a and that thereof he should fail &a Att which said third tuesday of November to witt the ninteenth day of the same month Ann.o Dom One thousand Seven hundred and thirty four being the day of the Return of the said Writt cometh the afd John Maglaughlin by William Beckingham Gent his attorney and the Sheriff of Somerset County to whom the foregoing writt was directed Likwise Cometh and maketh return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus so answers Joseph MaClester sher And the said Mary Stilley by Francis Allen her attorney Cometh and defendeth the force and Injury when &.a and prayeth Leave ^thereof^ to Imparle here untill next Court and she hath it and the same day is given to the afd John Maglaughlin adm.r as afd here also &a Att which said next Court to witt the Eighteenth day of march ann.o Dom One thousand Seven hundred and thirty four Came againe as well the afd John Maglaughlin adm.r as afd as the afd Mary Stilley by their attorneys afd and whereupon the said Mary by her attorney afd offers herselfe against the afd John in the plea afd but the same John altho' Solemnly Called Comes not nor prosecutes his writt afd against the said Mary &.a therefore |
