1735 55 likewise cometh and maketh return thereof to the Court here Endorsed in these words Following Viz.t Non Est Inventus short note left p Jos: Macclester sherr Whereupon the said John Brett by his attorney af.d prays that forasmuch as he hath complyed with the law in order to an attachment he may have Judgment against the said Edward Thompson for his damages af.d by way of attachment according to act of assembly &.a whereupon for that it seems to the Court here that the said John Brett has Complyed with the law as alledged Therefore it is Considered by the Court here that the aforesaid John Brett recover against the aforesaid Edward Thompson his damages af.d to the af.d Eight pounds Seven shillings and Six pence halfe penny Currt mony as also all Costs and Charges by the said John laid out and Expended by way of attachment 205 against the goods chattles Rights or Creditts of the af.d Edward Thompson according to act of assembly in such Case made and provided &.a Ordered by the Court that Messrs James Martin and William Lane lay out a road from Peter Claywells Jun.r over Cankers Creek by Richard Sturges plantation into the old road by Christopher Glasses plantation the said road to be Laid out of the Least of prejudice to any person or persons whatsoever &a Ordered that George Olliver of Somerset County planter have an order for one thousand pounds of tobacco he bringing in the best peice of Linnen according to act of assembly in such Case made and provided &a which order was delivered him in Capt Joseph MaClester high Sheriff of Somerset County for the same tobacco &a Ordered that Capell King of Somerset County Gent have an order for Eight hundred pounds of tobacco he bringing in the second best peice of Linnen according to act of assembly in Such Case made and provided &.a which order was delivered him on Capt Joseph MaClester high Sheriff of somerset County for the same tobacco &a Ordered by the Court that John Hurst Recover against Isaac Moor sixty pounds of tobacco for his attendance two days as an Evidence on behalfe of the said Isaac Moor against William M[illegible] he having made Oath to the Same &a Ordered by the Court that Charles Dashiell John Badley Major Floyd and Richard Hooffington recover against John Shiles Ninty pounds of tobacco Each for their attendance three days Each on behalf of His Lordship against the said John Shiles they having made Oath to the Same &a |
