and defendeth the force and Injury when &.a and prays leave thereof to Imparle
hereuntill next Court and he hath it and the same day is given to the af.d Signey
herealso &.a                            Att which said next Court to witt the seventeenth
day of June                           Ann Dom One thousand Seven hundred and thirty
five came againe as well the af.d Signey Brown as the af.d John Shiles by their
attorneys af.d and whereupon the said John Shiles offers himselfe against the said Signey
    Brown in the plea afd but the said Signey altho' Solemnly Called Cometh not nor is his writt
    aforesaid further prosecuted &a

          Therefore he and his pledges of prosecuting be in mercy and Lett the plantiff name
    pledges &a and hath the afd John Shiles go thereof without day also it is Considered by the Court
    here that the aforesaid John Shiles recover against the aforesaid Signey Brown his damages by
164   Occasion of the premisses to One hundred and Sixty Four                         pounds of tob.o
    to the Same John Shiles by discretion of the Justices here at his request for his Costs and Charges
    in that part Sustained according to the form of the Statute thereof Lately made and provided adjudged &.a

    Command was given to the Sheriff of Somerset County that he Should
take John Odear late of Somerset County planter if he
should be found in his bailywick and him should safe keep
so that he might have his body before the Justices of his
Lordships County Court of Somerset to be held at dividing Creek the third Tuesday
of March then next to answer unto Moses Tilman of a plea of trespass upon
the Case &.a   And that thereof he should not fail &.a

Att which said third Tuesday of March to witt the Eighteenth day of the same
month Ann Dom One thousand seven hundred and thirty four being the day of the
return of the said writt cometh the said Moses Tilman in his own proper person
and the Sher of Somerset County to whome the foregoing writt was directed likewise
cometh and maketh the return thereof to the Court here Endorsed in these words Following
Viz.t                     Cepi Corpus                           p Jos: Macclester Sher

Whereupon the aforesaid John Odear by Francis Allen his attorney cometh and
defendeth the force and Injury when &.a and prays leave thereof to Imparle hereuntill next
Court and he hath it and the same day is given to the aforesaid Moses herealso &.a

Att which said next Court to witt the Seventeenth day of June Ann Dom One
thousand Seven hundred and thirty five came againe as well the af.d Moses Tilman
in his proper person as the af.d John Odear by his attorney af.d and the said Moses Tilman
his writt aforesaid against the said John Odear did not prosecute &a
