49 Injury when &.a and saith that he did not assume upon himselfe in manner and form as the aforesaid Cornelius above against him hath Complained and of this he puts himselfe upon the Country and the said Cornelius in Like manner Thereupon it is Commanded the sheriff of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordships County Court of Somerset now Sitting at dividing Creek in the Same County twelve &.a by whom &.a and who neither &.a to recognize &.a becaus of well &a and afterwards Immediately Came thereof the Jury &.a and the Jurors of that same Jury by Ja.s MccClester Gent sheriff of the County aforesaid to this Impannelled being Called Came to witt John Waters Thomas Waller Angello atkinson Jonathan Sturges Geo: Benston James Breman William Mills Rich.d Chambers James Nearn John Lane Archibald White and Moses Chaille who to say the truth of the premisses aforesaid being duely Elected tryed and Sworn upon their Oath do say that the said Thomas Billings did not assume upon himselfe in manner and form as the aforesaid Cornelius Kollock above against him hath Complained &a Therefore it is Considered by the Court here that the aforesaid Cornelius Kollock take nothing by his writt and declaration aforesaid but be in mercy for his false Clamour and that the said Thomas Billings go thereof without day and further it is Considered by the Court here that the afd Thomas Billings recover against the said Cornelius Kollock pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same Thomas here according to the form of the Statute in such Case thereof Lately made and provided of his assent adjudged and that the afd Thomas have thereof Execution &a
