4 the fifth day of November Ann Dom Seventeen hundred thirty and four at the parish af.d in the County af.d within the Jurisdiction of this Court in and upon Charles Ratcliffe (the Same Charles then and there being a Justice of the peace of the Same County) in the peace of God and of the s.d Lord Prop.ry then and there being with force and arms an assault did make and the said Charles Ratcliffe then and there did beat wound and Evilly treat so that of his life it was much despaired and other harms to him then and there did to the great damage of the said Charles and against the peace of the said Lord prop.ry his good rule and dignity &.a Test Charles Rackliff Benjamin ^Walton^ Richard Simpson & Richard Logwood On the backside of the foregoing Bill of Indictment it was thus Endorsed Vizt Billa Vera Thomas Humphrys foreman Thereupon Command was given to the sheriff of Somerset County that he should take the said William Walton if &.c to answer &.c And afterwards to witt the Eighteenth day of March anno Dom One thousand seven hundred and thirty four before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in the same County Came the said William Walton in his proper person and had a hearing of the Indictment afd and says that he is not Guilty thereof and of this he is not Guilty thereof and of this he puts himselfe upon the Country and William Goldsborough Gent attorney of his said Lordship and who for his said Lordship in that part followeth Likewise Afterwards the said William Walton in his Own proper person present here in Court as afd relinquisheth his Verification afd and Submitts with a protestation of his innocency and putts himselfe upon the favour of the Court &a Whereupon all and singular the premises by the Court here seen heard and fully understood It is Considered that the afd William Walton Jun.r pay unto his Lordship the Lord proprietary for his fine by the Court hereupon him Imposed for an by Occasion of the premisses afd whereof in form afd he is Convict fifty shillings Currant money and that the same William Walton Jun.r be taken to satisfie his said Lordship of the fine afd &a Whereupon the said William Walton is ordered by the Court here to give recognizance for his good behaviour and appearance at June Court next to be held at dividing Creek for the County afd &a Whereupon the said William Walton Jun.r with Nathaniel Crapper of Somerset Coty planter his security both present herein Court in their proper persons acknowledged themselves indebted unto his Lordship the Lord proprietary in ten pounds Sterling Each of their goods and Chattells Lands and tenements Severally to be made and Levied to the Use of his said Lordship his heirs and Successors If it happen that the said William Walton do not make his personall appearance before the Justices of his Lordships County Court of somerset to be held at dividing Creek the third tuesday of June ^next^ to answer unto his said Lordship of ^and Concerning^ such matters and |
