(43) nottice by Reason of which premisses & also by force of the act of assembly afd action hath accrued to the same Joshua as assignee of the said John to require & have of the said William the said twenty pounds Cash Maryland Currency as af.d Nevertheless the af.d William altho' often required the af.d twenty pounds Cash Maryland Currency unto the afd Joshua hath not paid but that unto him hitherto to pay altogether hath refused and Still doth refuse to the damage of the same Joshua forty pounds Cash Maryland Currency & thereof he brings Suit &.a & doth bring hereinto Court the writing obligatory af.d which the debt af.d in form af.d testifyeth & the writing of assignment af.d on the said writing obligatory Inowed Pledges dep John Doe & R: Roe And the aforesaid William Booth by Francis Allen his attorney Cometh and defendeth the force and Injury when &.a and saith that he Cannot gainsay the action afd of the afd Joshua assignee as aforesaid nor Can he Say but that the writing Obligatory afd is the deed of him the Same William Booth nor but that he oweth the same Joshua ^the afd^ twenty pounds Cash maryland Currency in manner and form as the aforesaid Joshua above against him hath declared whereupon the said Joshua prays Judgment for his debt aforesaid and for his Costs and damages sustained by Occasion of the detaining of the Same debt to him to be adjudged &a Therefore it is Considered by the Court here that the aforesaid Joshua Caldwell assignee as aforesaid Recover against the aforesaid William Booth his debt aforesaid and his Costs and damages Sustained by Occasion of the detaining of that Same debt to two hundred and Eighty 288 Eight pounds of tobacco to the Same Joshua by the Court hereof his assent adjudged and the afd William in Mercy &a
