nottice by Reason of which premisses & also by force of the act of assembly afd action
hath accrued to the same Joshua as assignee of the said John to require & have of the said
William the said twenty pounds Cash Maryland Currency as af.d  Nevertheless the af.d
William altho' often required the af.d twenty pounds Cash Maryland Currency unto the
afd Joshua hath not paid but that unto him hitherto to pay altogether hath refused
and Still doth refuse to the damage of the same Joshua forty pounds Cash Maryland
Currency & thereof he brings Suit &.a & doth bring hereinto Court the writing obligatory
af.d which the debt af.d in form af.d testifyeth & the writing of assignment af.d on
the said writing obligatory Inowed                              Pledges dep John Doe & R: Roe

       And the aforesaid William Booth by Francis Allen his attorney Cometh and defendeth the force
       and Injury when &.a  and saith that he Cannot gainsay the action afd of the afd Joshua assignee as
       aforesaid nor Can he Say but that the writing Obligatory afd is the deed of him the Same William
       Booth nor but that he oweth the same Joshua ^the afd^ twenty pounds Cash maryland Currency in manner
       and form as the aforesaid Joshua above against him hath declared whereupon the said Joshua
       prays Judgment for his debt aforesaid and for his Costs and damages sustained by Occasion of the
       detaining of the Same debt to him to be adjudged &a

                            Therefore it is Considered by the Court here that the aforesaid Joshua Caldwell assignee
       as aforesaid Recover against the aforesaid William Booth his debt aforesaid and his Costs and
       damages Sustained by Occasion of the detaining of that Same debt to two hundred and Eighty

Somerset County sst     Thomas Fletcher late of Somerset County in the
province of Maryland Gent otherwise called the Rev.d Tho.s
Fletcher of the same County and province Gent was Sumoned
to answer unto Joshua Caldwell Assignee according to the
form of the act of assembly in such case ^lately^ made and provided of John Adkinson
of a plea that he render unto the same Joshua the sum of twenty
pounds cash Maryland Currancy which unto him he oweth and unjustly
detaineth &cra

And Whereupon the same Joshua by George Douglas his attorney
saith that whereas the af.d Thomas the twenty ninth day of November
Ann Dom seventeen hundred thirty and three at Somerset County af.d
by his certain writing Obligatory had granted himself to be bound unto
the af.d John in the af.d sum of twenty pounds Cash Maryland Currancy
