318 and the same Mary then and there did beat wound and evilly treat so that of her life it was much despaired and other hams harms to her then and there did to the great damage of the same Mary and against the peace of the said Lord proprietary that now is his good rule and Government &c Testes John Follows Mary Follows One the foregoing Bill of Indictment it was Endorsed viz.t True Bill W.m Jones Foreman Thereupon Command was given to the sheriff of Somerset County that he should take the said William Hayman Jun.r if he should be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held in the Court house at dividing Creek in the same County the third tuesday of March then Next to answer unto his said Lordship of and Concerning the Indictment af.d for trespass and assault &c and that thereof he should not fail &c And afterwards the said third tuesday of march to witt the fifteenth day of the same mounth Anno Dom one thousand seven hundred and thirty six before the Justices of his Lordships County Court of Somerset now here held in the Court house at dividing Creek in and for the same County Came the said William Hayman Jun.r in his proper person and had a hearing of the Indictment af.d ^and^ being Instantly demanded how he would acquitt himself of the premisses af.d as by the Indictm.t af.d above upon him Imposed says that of the premisses afd as by the Indictment afd ^above^ upon him Imposed he is Guilty thereof &c Whereupon all and Singular the premisses by the Court here seen heard and fully understood It is Considered that the af.d William Hayman Jun.r pay unto his Lordship the Right Honourable the Lord proprietary for his fine by the Court hereupon him Imposed for and by Occasion of the trespass and assault af.d whereof in form af.d he is Convicted two shillings and six pence Curr.t money of Maryland and that the said William Hayman Jun.r be taken to satisfie his said Lordship of the fine af.d &c Whereupon It is ordered by the Court here that the said W.m Hayman Jun.r give Security for the payment of the Severall officers their Fees due upon the Indictment afd Thereupon a Certain James Anderson of Somerset County planter present herein Court in his proper person undertook for the said William Hayman and assumed upon himselfe that he would pay unto the Severall Officers their fee or fees due by means of the premisses afd on the Indictment afd In Case the said William Hayman doth not pay the same &c The remaining part of this Courts proceedings is Entered in Liber P Thomas Hayward Cl Cur Comr Somr |
