examine evidences on behalf of a Certain Phillip Selby of the County af.d in Relation to the bounds of a tract of Land Called Ceder Grove or any other Lands Joyning to the same We therefore Require you or any three or two of you at some ^time^ and place as to you or any three or two of you shall seem Convenient you meet on the af.d Land Called Ceader grove or any the Lands Joyning (You first having taken your oaths on the holy evangelist of almighty God according to Act of assembly in such case made and provided an there Cause to come before you or any three or two of you all such evidences as shall be to you or any three or two of you nominated by the said Complainant or def.t if any and that you or any three or two of you Examine them upon there Corporall oaths to be by you or any three or two of you administred on the holy evangelist of almighty God in the presence of the Complaine^n^t or def.t if any touching the truth or Remembrance of there knowledge or any thing that may relate to the Cause af.d and that Reducing the severall depositions into writing you send the same together with this our Commission under your or any three or two of your hands and seals to us to our County Court of Somerset with all Convenient speed Wittness Robert King Gen.t Chief Justice of our said Court the 19.th day of June in the 22.d Year of our Dominion &.c Anno Dom 1736 On the foregoing Commission it was endorsed as Followeth viz.t August the 14th 1736 Came Cap.t William Lane and M.r John Pope before me the subscriber and was duely Qualifyed to execute the within Commision according to ^the^ directions of an Act of assembly in that case made Sworn day and year above written before me Jam.s Martin Now hereat this day to witt the fifteenth day of march anno Dom One thousand seven hundred & thirty Six Came William Lane and John Pope two of the Gent mentioned in the above Commission and made return thereof to the Court here Endorsed with the Severall affidavitts following thereto annexed vizt November 10.th 1736 We the Subscriber doe hereby Certifie that we have duly Executed the within Commission having first given due notice to all persons Conserned According to the Act of assembly in that case provided William Lane John Pope Somerset ss.t November y.e 10.th 1736 John Purnall Sen.r of the County af.d planter aged sixty four years or there abouts being by us sworn upon the holy evangelist of almighty God deposeth and saith that about forty years ago to the best of his knowledge M.r Daniel Selby shewed him a white Oak standing on the south side of Pikes Creek (les Bever Dam Creek) about forty pole from the said Creek and on (the |
