294 expend whereupon the said Thomas and Sarah say they are worse and have damage to the value of one hundred pounds Curr.t money of Maryland thereupon they bring suit &c Pledges &c Jno Doe & R Roe And the afd Rebecca Obryan by George Douglas her attorney comes and defends the force and Injury when &c and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Thomas and Sarah here also &c Att which said next Court to witt the Fifteenth day of June Anno Dom one thousand seven hundred and thirty six Came againe as well the afd Thomas and Sarah as the afd Rebecca by their attorneys afd And whereupon the said Rebecca prays further leave thereof to Imparle here untill next Court and she hath it and the same day is given to the afd Thomas and Sarah here also &c Att which said next Court to witt the Seventeenth day of august anno Dom One thousand Seven hundred and thirty Six Came againe as well the afd Thomas and Sarah as the afd Rebecca by their attorneys afd And whereupon the same Rebecca prays further Leave thereof to Imparle hereuntill next Court and she hath it and the Same day is Given to the afd Thomas and Sarah here also &c Att which said next Court to witt the sixteenth day of November anno Dom One thousand seven hundred and thirty Six Came againe as well the afd Thomas and Sarah as the afd Rebecca by their attorneys afd and whereupon the Same rebecca before defends the force and Injury when &c and says she is not guilty of the premises above upon her imposed in manner and form as the said Thomas and Sarah above against her have complained and of this she puts her self on the Country and the afd Thomas and Sarah in like manner afterwards to witt the Same day and Year Last Mentioned The afd Thomas Fletcher and Sarah his wife their writt & declaration afd against the afd Rebecca Obryan did not prosecute with Effect but Voluntarily suffered their suit to be discontinued (without Costs) Therefore it is Considered by the Justices here that the afd Thomas Fletcher & Sarah his wife and their pledges of prosecuting to witt John Doe & Rich.d Roe be in mercy and that the said Rebecca Obryan goe thereof without day &c For as much as A Certain Edward Cluff had upon his petition to this Court in august Last obtained an Order of the same Court for the turning of the Road that Ledd from Manocan by his plantation which was then Granted him upon Condition of his making the same new road as good and passable as the old road &c And at the same time it was then ordered by the Court that a Certain Giddion Tillman and Thomas Hayward Inspect the same new road and make their report this Court &c Now here at this day to witt the twenty third |
