291 day of the Same Month anno Dom One thousand Seven hundred and thirty Six Came againe as well the afd Richard Hickman Francis Wharton Benja Derickson and Geo: Howard by George Douglas their attorney as the afd John Linch by Francis Allen his attorney and whereupon the said Richd Hickman Francis Wharton Benja Derickson and George Howard prays that the afd John Linch to their Bill afd may Answer &c and thereupon it is said by the Court here to the said John Linch that he answer the Bill afd by next Court &c and the same day is given to the afd Plfts here also &c Att which said next Court to witt the seventeenth day of August Anno Dom One thousand Seven hundred & thirty Six Came againe the afd Richard Hickman Benja Derickson Francis Wharton & Geo: Howard by their attorney afd and the Said John Linch altho' Solemnly Called Came not nor answered the bill afd but made default &c Thereupon Command is given to the sher of Somerset County that he should attach the said John Linch if &c so that he might have his Body before the Justices of his Lordships County County Court of Somerset to be held at dividing Creek in the same County the third Tuesday of November then next to answer unto his Lordship of and Concerning his not answering the Bill afd according to rule of Court but departing in Contempt thereof &c Att which said next Court to witt the Sixteenth day of November anno Dom One thousand seven hundred and thirty Six Came againe the said Richard Hickman Francis Wharton Benja Derickson and George Howard by their attorney afd and the sher of Somerset County to witt Joseph McClester Gent Likewise Came and returned that the afd John Linch is not found &c Whereupon the said Richard Hickman Francis Wharton Benja Derickson and George Howard by their attorney ^afd^ pray that no Execution may Issue against them by the afd Jno Linch on the Condemnation afd in the Bill aforementioned untill the said Linch appear and the premisses afd on the Bill afd be fully determined &c which is by the Court hereunto them Granted &c Therefore it is Considered by the Justices her that there be a Stay of Ex.n on the Condemnation afd and by the afd John Linch against the afd Richard Hickman Francis Wharton Benj.a Derickson and Geo Howard Garnishes of the afd Willm Jennings untill such time as the premisses on the bill afd be fully determined &c Thomas Goddart Late of Somerset County planter Came here into Court in his proper person according to a Certain Writt of attachment against him Issued for not appearing before the Justices of his Lordships County Court of Somerset he being Legally Summoned thereto for not burning of tobacco according to act of assembly in such Case made and provided And for as much as the said Thomas Goddart hath nothing to Object that was Materiall but was Willing to pay his fine for the Same Wherefore it is Considered by the Court here that the said Thomas Goddart pay unto his Lordship the Lord Proprietary for his fine for and by occasion of the premisses afd Twenty Shillings Curr.t money of Maryland &c For as much as a Certain James [illegible] As by Law he was Obliged to burn [illegible] |
