290 body before the Justices of his Lordships County Court of Somerset at the same day and place in the writt aforesaid mentioned he had there Ready &c Therefore he and his pledges of prosecuting being in mercy and the plft name pledges &c and That the afd Thomas Covington go thereof without day also it is Considered that the afd Thomas Covington recover against the afd John Shiles his damages by occasion of the premisses 161 to One hundred and Sixty One pounds of tobacco to the Same Thomas Covington by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute in Such Case Lately made and provided by the Court here adjudged &c memorandm should Inclose & Imps & default for not decl on the next Entry before it
Lordship County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of August the next to answer unto Thomas Holbrook of a plea of trespass upon the Case &c and that thereof he Should not fail &c Att which said third Tuesday of August to witt the Seventeenth day of the same month anno Dom One thousand Seven hundred and thirty Six Being the day of the return of the Same Writt Came the said Thomas Hoolbrook by ^Thomas Bluett^ his attorney and the sheriffe of somerset County to whom the foregoing writt was directed Likewise Came and made return that by virtue of the Writt afd to him thereof directed he had taken the body of the said Thomas Hearn whose body before the Justices of his Lordships County Court of Somerset at the same day and place in the writt afd mentioned he had there ready &c And the afd Thomas Hearn by George Douglas his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle hereuntill next Court and he hath it & the Same day is given to the afd Thomas Hoolbrook here also &c Att which said next Court to witt the sixteenth day of November anno Dom One thousand Seven hundred and thirty Six Came againe as well the afd Thomas Hoolbrook as the afd Thomas Hearn by their attorneys afd and because the afd Thomas Hoolbrook did not declare agt the afd Thomas Hearn by the Twentieth day of January then next following nor prosecutes his writt afd Therefore he and his pledges of prosecuting be in mercy and the plft name pledges &c and that the afd Thomas Hearn goe thereof without day also it is Considered by the Justices here that the afd Thomas Hearn Recover against the afd Thomas Hoolbrook his damages by occasion of the premisses 161 to One hundred and Sixty one pounds of tobacco to the same Thomas Hearn by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of the Statute &c |
