251 whole Gold and two pounds in paper money of the Province of Maryland by the same Henry at the speciall Instance and request and to the proper use of the said William before that time laid out and expended and so thereof Indebted being the afd William afterwards (to witt) the same day and year afd at the place afd in Consideration thereof upon himself did assume and to the same Henry then and there faithfully did promise that he the said William the afd nine pounds and thirteen shillings in whole Gold and two pound in paper Currency of the province of Maryland to the said Henry when thereof afterwards he should be thereunto requested he would well and faithfully pay and Content Nevertheless the afd William his promise and assumption afd in form afd made nothing regarding but minding and fraudulently intending the afd Henry in that part Craftily and subtilly to deceave and defraud the afd nine pounds and thirteen shillings in whole Gold and two pounds paper Currency afd or any penny thereof to the same Henry hath not paid nor to him for the same in any sort Contented altho' the same to do the afd William afterwards (to witt) the same day and year afd and at the place afd and often since that time by the same Henry he was thereunto requested but the same to him hitherto to pay or in any sort content the said Wm hath altogether refused and still doth refuse to the damage of him the said Henry twenty pounds Currt money of Maryland and Thereof he he brings suit &c Pledges &.a John Doe & Rd Roe And the afd William Wye in his proper person Cometh and defendeth the force and Injury when &a and saith that he Cannot gainsay the action afd of the afd Henry Jeoffry nor but that he did assume upon himselfe in manner and form as the afd Henry Jeofrey above against him ^hath^ Complained and as to the damage of the Same Henry Jeoffrey by him by Occasion of the premisses in that part sustained the Same William saith and acknowledg^eth^ that the afd Henry Jeffrey has Sustained Damages by Occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to Nine pounds thirteen shillings in whole Gold and two pounds in paper Currency and not more and because the afd Henry Jeoffry denys not this but the same allegation Confesseth to be true prays Judgmt for those damages [illegible] Together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Henry Jeoffry Recover against the afd William Wye his damages afd to the afd Nine pounds thirteen shillings in whole gold and two pounds paper Currency by the Same William in form afd Confess^ed^ as also two hundred and thirty 212 four pounds of tobacco for his Costs and Charges afd to the Same Henry at his request by the Court here and Consent of the parties afd adjudged with stay of Exn till the Last day of Novr ^then^ Next and ye afd deft in Mercy &a |
