224 one at Somerset County afd within the Jurisdiction of this Court was indebted to the said Thomas Lambden in the sum of one hundred and one pounds seventeen shillings and five pence half penny Current money of Maryland for sundry goods wares and Merchandize by the afd William of the afd Thomas Lambden before that time had and receivd and for divers sums of Money at the Speciall Instance and request of the said William and to and for his proper use by the said Thomas Lambden likewise before that time laid out and Expended properly chargeable in an Account as by an Account thereof here into Court brought may appear and being so thereof Indebted the said the said William in his life time (to Witt) the day and year afd at the place afd in Consideration thereof upon himself did assume and to the said Thomas Lambden then and there did faithfully promise that he the said William the afd one hundred and one pounds seventeen shillings and five pence half penny unto the said Thomas Lambden when he should be thereunto requested he would well and faithfully pay and Content and altho the said William in his life time seventeen pounds twelve shillings and three pence to the said Thomas Lambden he paid ^and^ satisfied Nevertheless as to eighty four pounds five shillings and two pence half penny residue of the afd one hundred and one pounds seventeen shillings and five pence half penny the said William in his life time his promise and assumption so as afd made nothing regarding but plotting and fraudulently intending the said Thomas Lambden in that part Craftily and subtilly to deceive and defraud the said eighty four pounds five shillings and two pence half penny to the said Thomas Lambden hath not paid or Contented nor either of them hath paid or Contented altho' the same William in his life time (to witt) on the afd first day of June seventeen hundred thirty and one and often afterwards and the afd Thomas Gardner and Thomas Billing since the decease of the said William (to Witt) ^on^ the Tenth day of february one thousand seven hundred thirty and three and often afterwards at the County afd within the Jur afd was thereunto requested by him the said Thomas Lambden but the same to the said Thomas Lambden to pay the said William in his life time hath refused and the same to the said Thomas Lambden to pay the said Thomas Gardner and Thomas Billings do still refuse and deny Wherefore the said Thomas Lambden saith that he is the worse and hath damage to the value of one hundred pounds Currant Money of Maryland and thereupon he bringeth suit &c Rob.t Jenckins Henry p Que Pl &c Jno: Doe &c R Roe 1
