his attorney Complaineth that Whereas the afd Richard the twelfth day of July in the Year of Our Lord seventeen
hundred and thirty five at Somerset County within the Jurisdiction of this Court was possessed
of three thousand Cyprus Shingels of the value of four pounds as of his proper shingels  And so
being thereof possessed the said Richard afterwards to witt the af.d twelfth day of July in the
year of our Lord one thousand seven hundred thirty and five at Somerset County af.d the af.d
three thousand Cyprus shingels out of his hands and possession casually lost which same three
thousand Cyprus Shingels so lost afterward (to witt) the same day and year af.d at the place
af.d to the hands and possession of the abovesaid Solomon by finding came  Nevertheless the
af.d Solomon knowing the three thousand Cyprus Shingles to be the proper shingles of him the
said Richard and to him the said Richard of right to belong and appertain not withstanding
evilly and fraudulently intending the same Richard in that part to deceive and defraud the
three thousand Cyprus shingles af.d and altho' often thereunto requested to the same Richard
hath not delivered but the three thousand Cyprus Shingles af.d afterward (to witt) the
thirteenth day of July in the year af.d at the County af.d and within the Jurisdiction af.d
to his proper use did Convert and dispose to the damage of the same Richard eight pounds
Currant money of Maryland  And thereof he brings Suit &c                     Pledges &a  Jn.o Doe

    And the afd Solomon Tomlinson by William Beckingham his attorney Cometh and defendeth the
force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and he hath it &
the same day is given to the afd Richard here also &a

             Att which said next Court to witt the sixteenth day of march anno Dom One thousand seven hundred
and thirty five Came againe as well the afd Richard Brooks as the afd Solomon Tomlinson by their
attorneys afd and whereupon the same Solomon prays further Leave thereof to Imparle hereuntill the
next Court he hath it and the same day is given to the afd Richard Here also &a

    Att which said next Court to witt the fifteenth day of June anno Dom One thousand Seven hundred
and thirty Six Came againe as well the afd Richard Brooks as the afd Solomon Tomlinson by their
attorney afd and whereupon the said Solomon as before defends the force and Injury when &a
and saith that he is in noe sort Guilty of the premisses above against him alledged and of this he
puts himselfe upon the Country   and the afd Plft in Like manner

    Thereupon it is Commanded the Sheriffe of Somerset County that Immediately he should Cause to Come
here before the Justices of his Lordships County Court of Somerset now sitting at dividing Creek in the
same County twelve &a by whom &.a and who neither &.a to recognize &.a because as well &.a and
afterwards Immediately Came thereof the Jury &.a and the Jurors of that same Jury by Joseph
