205 same Thomas in^to^ great trouble and vexation to bring and him from the benefit of his testimony to deprive in the presence and hearing of Divers liege subjects of the same Lord the King of his ^wicked^ Malice fore thought in the presence and he^a^reing of divers liege subjects of the said Lord the King to the same Thomas of and concerning the same Thomas these following false scandalous and malitious english words and lies did pronounce publish and declare viz.t You (the same Thomas Meaning) are a Convict and a newgate Rogue And you (the same Thomas still Meaning) are a Damned Newgate Bird son of a Bitch by means whereof the same Thomas Lambden is not only in his good name and esteem much hurt and prejudiced but those with whom he was acquainted from his company have with drawn Whereby he saith that he is damnified and hath loss to the value of one hundred pounds Currant money and thereof he brings Suit &c Wil Beckingham And the afd Nathaniel Brittingham by George Douglas his attorney Comes and defends the force and Injury when &.c and prays Leave thereof to Imparle ^hereuntill next Court^ and he hath it and the Same day is given to the afd Thomas Lambden here also &a Att which said next Court to witt the ninteenth day of August month anno Dom One thousand seven hundred and thirty five Came againe as well the afd Thomas Lambden as the afd Nat Brittingham by their attorneys afd And whereupon the same Nathaniel prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd Thomas here also &.a Att which said next Court to witt the eighteenth day of November anno Dom One thousand seven hundred and thirty five Came againe as well the afd Thomas Lambden as the afd Nathaniel Brittingham by their attrnys afd And whereupon the same Nathaniel prays further Leave thereof to Imparle hereuntill next Court & he hath it and the same day is given to the afd Thomas here also &a Att which said next Court to witt the sixteenth day of March anno Dom One thousand seven hundred and thirty five Came againe as well the afd Thomas Lambden as the afd Nathaniel Brittingham by their attorneys afd and whereupon the same Nathaniel prays further Leave to Imparle hereuntill next Court and he hath it and the Same day is given to the afd Thomas here also &a Att which said next Court to witt the fifteenth day of June anno Dom One thousand seven hundred and thirty Six Came againe as well the afd Thomas Lambden as the afd Nathaniel Brittingham by their attorneys afd and whereupon the same Nathaniel as before defends the force and Injury when &a and saith that he of the premisses above upon him Imposed is not guilty in manner & form as the afd Thomas above against him hath Complained and of this he putts himselfe upon the Country and the afd Thomas in Like manner Thereupon it is Commanded the sheriffe of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordships County Court of Somerset now sitting at dividing Creek |
