164 Att which said next Court to witt the Sixteenth day of March anno Dom one thousand seven hundred & thirty five Came againe as well the afd Robert Geddes as the afd William Beavins by their attorneys afd and whereupon the same William Bevins as before defends the force and Injury when &.a and saith that he did not assume upon himselfe in manner and form as the afd Robert Geddes above against him hath Complained and of this he putts himselfe upon the Country and the afd Plft in Like manner Whereupon the afd Robert Geddes by his attorney afd prays the Justices here the same day and Year last mentioned that they ^would^ proceed to and hear and determine the dispute in the action afd between him and the afd William Beavins according to the rules of Equity and good conscience according to act of assembly in Such Case made and provided &.a Whereupon the Justices here at the prayer of the afd Robert Geddes and by the Consent of the afd William Bevins having heard the severall allegations as well on the part of the afd Plft ^as on the part of^ the afd deft and Likewise Examined the same deft on oath and Severall Evidences being Sworn to testifie in the premisses and all and Singular the Severall allegations of both plft and defend.t and what was delivered upon Oath being by the Justices weighed and fully understood and mature deliberation thereupon had Wherefore it seems to the Justices here that the afd Robt pay unto the afd William all his Costs and Charges by him Expended as well at Common Law as Equity &a Therefore it is Considered and decreed by the Justices here that the afd Robert Geddes take nothing by his writt and declaration afd but be in mercy for his falce Clamour and that the said William Beavins goe thereof without day and further it is Considered by the Justices here that the afd William Beavins Recovere against the afd Robert Geddes Eight hundred and Five 783 pounds of tobacco for his Costs and Charges by him about his defence as well at Common Law as in Equity Expended unto the Same W.m by the Court here adjudged &a
of Tobacco to be Levied on your bodies goods and Chattles Lands or tennements for the use of the said John Dennis Ju.r in Case the said Edward Poynter shall not pay and Satisfie to the said John Dennis Ju.r the said five hundred and forty five pounds of Tobacco so as af.d Recovered against him with the Additionall Cost thereon ^on^ the tenth day of Feb.ry next taken Before me this 12 Day of November 1735 James Martin To Mr Hayward |
