163 Francis Allen late of Somerset County Gent and undertook for the same Robert Geddes and assumed upon himselfe [Likewise the said Robert Geddes assumed upon himselfe] that if in Case the said George Bounds should recover Judgment in the plea aforesaid against the said Robert Geddes or that the said Robert Geddes should be therein Convict that then he the said Robert Geddes should pay the Judgment of the Court thereon or render his body in Execution of Such Judgment to the prison of the Sheriff of Somerset County in Satisfaction thereof or that he the said Francis Allen will do the Same for him &a And whereupon the said Robert Gddes by William Beckingham his attorney Comes and defends the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd George Bounds here also &a Att which said next Court to witt the Sixteenth day of March anno Dom One thousand Seven hundred and thirty five Came againe as well the afd George Bounds as the afd Robert Geddes by their attorneys afd And whereupon the same Robert as before defends the force and Injury when &a and saith that he did not assume upon himself in such manner and form as the af.d G^e^orge above against him hath declared and thereof he puts himself upon the Countrey and the plft Likewise Whereupon afterwards the Same day and Year Last above mentioned Came hereinto Court the afd Robert Geddes by his attorney afd and upon this the Same Robert relinquisheth his Verification ^afd^ by him above alledged and saith that he Cannot gainsay the action afd of the afd George Bounds nor Can he say but that he did assume upon himselfe in manner and form as the afd George above against him hath Complained and as to the damage of the Same George by him by Occasion of the premisses in that part Sustained the same Robert saith and Confesseth that the afd George hath sustained damages by Occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to five pounds tenn Shillings Currt money of Maryland and not more and because the afd George denys not this but the Same allegation Confesseth to be true prays Judgmt for those damages above Confessed together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered by the Court here that the afd George Bounds recover against the aforesaid Robert Geddes his damages afd to the afd Five pounds tenn Shillings Curr.t money of Maryland in form afd Confessed as also 274 pounds of tobacco for his Costs and Charges afd to the same George Bounds of his assent by the Court here adjudged with Stay of Execution untill the Eighteenth day of aprill next and the afd Robert in mercy &a
