160 aforesaid ^Thos Gray by their attrys afd^ and whereupon the same Thomas Gray by his said attorney as before defends the force and Injury when &.a and saith that he Cannot Gainsay the action afd of the afd Thomas Nevett nor Can he say but that the same Thomas Gray did assume upon himselfe in manner and form as the same Thomas Nevett above against him hath Complained and as to the damage of the Same Thomas Nevett by him by Occasion of the premisses in that part Sustained the same Thomas Gray saith and Confesseth that the afd Thomas Nevett hath Sustained damages by occasion of the premisses afd further than his Costs and Charges by him about his Suit in that part apposed to sixteen pounds ninteen Shillings and three pence Sterling and not more and because the afd Thomas Nevett denys not this but the Same allegation Confesseth to be true prays Judgmt for those damages above Confessed together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered by the Court here that the afd Thomas Nevett recover against the aforesaid Thomas Gray his damages aforesaid to the afd Sixteen pounds Ninteen shillings and three pence Sterling in form afd Confessed as alsoe Four hundred and Seventy Four 474 pounds of tobacco for his Costs and Charges afd to the Same Thomas Nevett by the Court here and Consent of the parties afd adjudged and the afd Thomas Gray in mercy &a
said Godfrey the twenty ninth day of March Seventeen hundred and thirty in Consideration that he the said William on the first day of november seventeen hundred and thirty four did hire and Lett out to the said Godfrey at the Spesial Instance and request of him the said Godfrey a Negroe man named Jacob which said negroe man did remain in the service & Employmt of the said Godfrey from the af.d fifth day of November in the year af.d untill the twenty Ninth day of march Anno Dom Seventeen hundred and thirty five the said Godfrey in Consideration that he the said William at the Speacil Instance and request of him the said Godfrey would permitt and suffer the said Negroe Jacob further to remain in the Service and Employment of him the said Godfrey after the said twenty ninth day of march in the year last af.d untill the full term ^& time^ of Six mounths from the af.d fifth day of November Seventeen hundred ^and^ thirty four should be well and truly Compleat and ended upon himself did assume and to the same William then and there did faithfully promise that he the said Godfrey for the Servise of the said negroe for the time af.d one thousand pounds of Tobacco to the said William after the Service af.d performed when he should be thereunto requested he would well and faithfully pay and Content and the af.d William in fact Saith that giving creditt to the promise and assumption af.d of the af.d Godfrey he did permit and Suffer the said negroe Jacob to remain in (the) |
