November Court
1735 124 (to witt) the aforesaid thirteenth day of July Ann: Dom: One thousand seven hundred thirty and two aforesaid at Somerset County aforesaid & within the Jur aforesaid upon himself did assume & to the said John White then and there faithfully did promise to pay to him the aforesaid fourteen hundred Cyprus boards according to the tenor of the same note Nevertheless the aforesaid John Lamberson his promise and assumption aforesaid in form aforesaid made nothing regarding but plotting & fraudulently intending the aforesaid John White in that part craftily & Subtilly to deceive and defraud the aforesaid fourteen hundred Cyprus Board or any part thereof to the same John White hath not as yet paid or him for the same in any sort Contented altho' the same to do the aforesaid John Lamberson afterwards (to witt) the same day & year & at the place last above mentioned and often afterwards by the said John White was requested but the same to him hitherto to pay or for the same in any sort to Content & satisfie the said John Lamberson hath altogether refused and still doth refuse and deny to the damage of him the said John White Ten pounds Current money of maryland and thereof he brings Suit &.a pledges dep Jn.o Doe & R: Roe Whereupon the said John Lamberson present herein Court in his proper person is by the same Court adjudged to give special bail to the action af.d Thereupon a Certain Edward Cluff of Somerset County blacksmith came hereinto Court in his proper person ^and^ undertook for the said John Lamberson and assumed upon himselfe (Likewise the said John Lamberson assumed upon himselfe) that if in Case the said John White should recover Judgment in the plea aforesaid against the said John Lamberson or that the said John Lamberson should be therein Convicted that then he the said John Lamberson should pay the Condemnation of the Court thereupon or render his body in Execution of such Judgment to the prison of the Sheriff of Somerset County in satisfaction thereof or that he ^the^ said Edward Cluff will do the same for him &.a And the aforesaid John Lamberson by George Douglas his attorney cometh and defendeth the force and Injury when &.a and prays leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the aforesaid John White herealso &.a Att which said next Court to witt the Nineteenth day of August Ann: Dom: One thousand Seven hundred and thirty five came againe as well the the af.d John White as the af.d John Lamberson by their attorney af.d and whereupon the same John Lamberson prays further leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d John White herealso &.a Att which said next Court to witt the EIghteenth day of November Ann: Dom: One thousand Seven hundred and thirty five came againe as well the af.d John White as the af.d John Lamberson by their attorneys af.d (and |
