November Court
1735 (114) Chargeable to pay unto the af.d John Reddish the af.d thirty three bushells and three pecks of Indian Corn according to the tenor of the note af.d and so therewith being chargeable the same John Wilcox in Consideration thereof afterwards to wit the same Eighteenth day of April in the year af.d at the County af.d upon himself did assume and to the same John Reddish then and there faithfully did promise that he the same John Wilcox the same thirty three bushells and three pecks of Indian Corn to the same John Reddish according to the Tenor of the note af.d well and faithfully would pay & Content Nevertheless the af.d John Wilcox his promise and assumption af.d so as af.d made nothing regarding but minding and fraudulently intending the same John Reddish in this part craftily and Subtilly to deceive and defraud the af.d thirty three bushells and three pecks of Indian Corn to the same John Reddish altho' do the same by the same John Reddish afterwards to witt the Eleventh day of November in the year af.d at the County af.d & often afterwards there the same John Wilcox was required hath not paid but that unto him to pay or for the same in any sort to Content hitherto altogether hath refused and still doth refuse to the damage of the same John Reddish Seven pounds Current money and thereof he brings Suit &.a Pledges &.a Jn.o Doe & R.d Roe Whereupon the said John Wilcox present herein Court in his proper person is by the same Court adjudged to give Speciall bail to the action af.d Thereupon a Certain Henry Toadvine ^late^ of Somerset County planter came hereinto Court in his proper person and undertook for the said John Wilcox and assumed upon himselfe (Likewise the said John Wilcox assumed upon himselfe) that if in Case the said John Reddish should recover Judgment in the plea af.d against the said John Wilcox or that the said John Wilox should be therein Convicted that then he the said John Wilox should pay the Condemnation of the Court thereupon or render his body in Execution of Such Judgment to the prison of the Sheriff of Somerset County in satisfaction thereof or that he the said Henry Toadvine will do the same for him &.a And the aforesaid John Wilcox by Francis Allen his attorney cometh and defendeth the force and Injury when &.c and prayeth leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d John Reddish herealso &.c Att which said next Court to witt the Seventeenth day of June of June Ann: Dom: One thousand Seven hundred and thirty Five came againe as well the afs.d John Reddish as the afs.d John Wilcox by their attorneys af.d and Whereupon the same John Wilcox prays further leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d John Reddish herealso &.c Att which said next Court to witt the Nineteenth day of August Ann: |
