November Court
1735 107 Esq.r of a plea that he render unto him Sixteen thousand four hundred and two pounds of Good sound merchantable Leafe tobacco which to him he oweth and unjustly detaineth &.a And whereupon the same Richard by Thomas Bluet his attorney saith that Whereas the af.d William the twenty Sixth day of November Ann: Dom: Seventeen hundred thirty and four at Somerset County af.d by his Certain writing obligatory had Granted himself to be bound unto the af.d Richard in the af.d Sum of Sixteen thousand four hundred and two pounds of Good merchantable leaf tobacco to be paid unto the same Richard when thereof afterward he should be required Nevertheless the af.d William altho' often required the af.d Sum of tobacco unto the af.d Richard hath not paid but that unto him hitherto to pay altogether ^hath^ refused and still doth refuse to the damage of the same Richard twenty thousand pounds of like tobacco and thereupon he bringeth Suite &.a and doth bring hereinto Court the writing obligatory af.d which the Debt af.d in form af.d doth testify the date whereof is the same day and year af.d &.a Pledges &.a John Doe & R.d Roe And the aforesaid William Wye by William Beckingham his attorney Cometh and defendeth the force and Injury when &a and saith that he Cannot gainsay the action afd of the aforesaid Richard Gildart nor but that the writing Obligatory aforesaid is the deed of him the Same William nor but that he oweth the Same Richard the aforesaid sixteen thousand four hundred and two pounds of tobacco in manner and form as the aforesaid Richard above against him hath declared &a Therefore it is Considered that the aforesaid Richard Gildart Recover against the aforesaid William Wye his debt aforesaid and his damages by Occasion of the detaining 321 of the Same debt to three hundred & forty three pounds of tobacco to the Same Richard of his assent by the court here adjudged and the aforesaid deft in Mercy &a
third tuesday of November then next to answer unto John Watson of a plea of trespass upon the Case &.a and that thereof he Should not faile &a And the aforesaid John Watson by George Douglas his attorney Complaineth against the afd John Aydelott in the plea afd as followeth viz.t Somerset Coty ss John Aydelott late of Somerset County planter was attached to answer unto John Watson |
