their attorneys afd and whereupon the same William West prays further Leave thereof to
Imparle here untill next Court and he hath it and the Same day is given to the afd Anthony

            Att which said next Court to witt the twentieth day of November Anno Dom One thousand
Seven hundred and thirty three Came againe as well the afd Anthony West as the afd William
West by their attorneys afd and because the afd Anthony West did not declare against the
afd William West in the plea afd by the first day of January next following nor prosecutes his
writt afd against the afd William West         therefore he and his pledges of prosecuting
be in mercy the plft name pledges &a and that the afd William West goe thereof without day
Also it is Considered that the afd William West Recover against the afd Anthony West
269   his damages by Occasion of the premisses to                                                pounds
of tobacco to the ^said^ William by discretion of the Justices here at his request for his Costs and Charges
in that part Sustained according to the form of the Statute &a by the Court here adjudged &a

William Horsey Late of Somerset County planter if he should be found in his
                               bailywick and him should safe keep so that he might have his body before the
    Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of august ^then^
    next to answer unto William Wye Jun.r of a plea of trespass upon the Case &a  and that thereof he should
    not fail &a
                                     Att which said third tuesday of August to witt the twenty first day of the Same
    month ann.o Dom One thousand Seven hundred and thirty three being the day of the return of the same
    writt Came the said William Wye by William Beckingham his attorney and the sher of Somerset
    County to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to
    the Court here Endorsed in these words following viz.t Cepi Corpus p Josh.a Caldwell sher

           And the afd William Horsey by Francis Allen his attorney Comes and defends the force and Injury
    when &a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the Same day
    is given to the afd William Wye here also &a
