November Court 1733 (95) pounds current money of maryland and four hundred and fifty six pounds of tobacco and thereupon he brings suit &a pledges &a John Doe & R Roe August 16.th 1733 William Hopkins Dr To your assumption to pay me for so Much due by your note past to me dated 13.th January 1733 being what Isued for in Somerset County Co.t 575 foot of good pine plank or corn to the value thereof against you ll Tob To your assumption to pay the cost of suit amounting as p Bill of Cost to 228 Errors Excepted p Robert Scott And the afd William Hopkins by his own proper person appears afd thereupon the said William Hopkins at the prayer of the afd Robert Scott by his attorney afd is adjudged to give special bail to the action afd Thereupon a Certain Abraham Owten of Somerset County planter present herein Court in his proper person assumed upon himselfe and undertook for the Said William Hopkins that if in Case the said Robert Scott should recover Judgment in the plea afd against the afd William Hopkins or that the Said William Hopkins should ^be therein Convict that the he the said Willm Hopkins should^ pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somerset County in Satisfaction thereof or that he the said Abraham Owten will do the same for him &a And the said William Hokins by William Beckingham his attorney Comes and defends the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd William here also &a Att which said next court to witt the Twenty first day of August anno Dom one thousand seven hundred and thirty three came again as well the aforesaid Robert Scott as the aforesaid William Hopkins by their attorneys aforesaid and and whereupon the same William prays further leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd Robert here also &a Att which said next court to witt the Twentieth day of November Anno Dom One thousand seven hundred and thirty three came again as well the aforesaid Robert ^Scott^ as the afd William ^Hopkins^ by their attorneys aforesaid and whereupon the Same Will.m Says that he Cannot Gainsay the action afd of the afd Robert nor Can he Say but that he did assume upon himselfe in manner and form as the afd Robert above against him hath Complained and as to the damage of the Same Robert by him by Occasion of the premisses in that part Sustained the same William saith and Confesseth that the afd Robert hath Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to five hundred and Seventy foot of good pine plank and two hundred and twenty Eight pounds of tobacco and not more and because the afd Robert denys not this but the same allegation Confesseth to be true prays Judgment and those damages above Confessed together with his Costs and Charges afd to him adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Robert Scott Recover against the afd William Hopkins his damages afd to the afd five hundred & Seventy five foott of good pine plank and two hundred and twenty Eight pounds of tobo by the afd William in form afd 304 Confessed as also three hundred & four pounds of tobacco for his Costs and Charges to the same Robert at his request by the Court here and Consent of the parties afd adjudged and the afd deft in Mercy &a |
