89 Charles then and there faithfully did promise that when afterwards he should be thereto Requested he the afd Sum of Six hundred and twenty five pounds of tobacco to the same Charles would well and faithfully Content and pay nevertheless the said Thomas his promise and assuption afd in form afd made Little regarding but plotting an fraudulently Intending him the Same Charles in that part Craftilly and Subtilly to Defraud and Deceive he the said Thomas the afd sum of Six hundred & twenty five pounds of Tobacco Not any Part thereof to the same Charles hath paid or him for it in any wise Contented altho' he the said Thomas afterwards to Witt the same Day and Year afd att thee County afd and Within the afd Jurisdiction was thereto requested by the same Charles but the said Thomas the same to doe hath altogether refused and still doth Refuse whereby the same Charles says he is worse and hath Damage to the Value of twelve hundred and fifty pounds of tobacco and thereof he brings suite &a pledges &a John Doe R Roe
December 3.d 1733 Personally appeared before me the Subscriber one of his Lordships the Right Honourable the Lord proprietary his Justices for the County of Somersett the above named Charles Ramsey and made Oath upon the holy Evangels of Almighty God that the above acc.t is Just and true and that the above ballance is Justly due to him and that he hath not Received any part or parcell of the same nor hath the above named Thomas Boreman an acc.t against him to discount the sd Debt or any part thereof Jurat Cor me Jno Scott Att which said third Tuesday of November to witt the twentieth day of the Same month Anno Dom One thousand Seven hundred and thirty three Came the Said Charles Ramsey by his attorney afd and the sher of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following viz.t Non est Inventus short note Left p Joshua Caldwell sher Whereupon the said Charles Ramsey by his attorney afd prays that for as much as he has Complyed with the Law in order to an attachment he may have Judgment against the said Thomas Boarman for his damages afd by way of attachment according to act of assembly &a Whereupon for that it Seems to the Court here that the said Charles Ramsey has Complyed with the Law as alledged Therefore it is Considered that the afd Charles Ramsey recover against the afd Thomas Boarman his damages by Occasion of the premisses afd to Six hundred and twenty five pounds of tobacco as also all Costs and Charges by him about his Suit in that part apposed by way of attachment against the goods Chattells Rights or Creditts of the said Tho.s according to act of assembly in Such Case made & provided &a |
