89 Whereupon the said William Hopkins in his proper person Comes and defends the force and Injury when &a and Says that he Cannot gainsay the action afd of the afd Thomas nor Can he Say but that he did assume upon himselfe in such manner and form as the afd Thomas above against him hath Complained and as to the damage of the Same Thomas by him by Occasion of the premisses in that part sustained the said William Saith and Confesseth that the afd Thomas hath Sustained damages by Occason of the premisses further than his Costs and Charges by him about his suit in that part apposed twelve pounds Ninteen shillings and ten pence Currant mony of Maryland and four hundred pounds of tobacco and not more and because the afd Thomas denyes not this but the Same allegation Confesseth to be true prays Judgmt for those damages afd above Confessed together with his Costs and Charges afd to him adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Thomas Stayton Recover against the afd William Hopkins his damages afd to the afd twelve pounds Ninteen shillings and ten pence Currant money of Maryland and four hundred pounds of tobacco as also two hundred and fifty five pounds of tobacco for his Costs and Charges afd to the Same Thomas by the Court here at his request and Consent of the parties afd adjudged and the afd deft in mercy &a Thereupon Immediately ^afterwards^ the said William Hopkins present here in Court in his proper person and thereupon the said William Hopkins at the prayer of the afd Thomas Stayton by his attorney afd is Committed into the Custody of the sher of Somerset County there to remain untill the said Thomas of the Judgmt afd Should be fully Satisfied the said sher to witt Joshua Caldwell Gent present here in Court took Charge of the said William accordingly &a
then next to answer unto Charles Ramsey of a plea of trespass upon the Case &a and that thereof he should not fail &a And the said Charles Ramsey by Francis Allen his attorney Complains against the said Thomas Boarman in the plea afd as followeth viz.t Somerset County ss Thomas Boarman Late of Somerset County planter was attached to answer Unto Charles Ramsey of a plea of trespass upon the Case &a And Whereupon the same Charles Ramsey by Francis Allen his Attorney Complains that Whereas the afd Thomas the tenth day of March Anno Dom one thousand seven Hundred and thirty Two at Somersett County within the Jurisdiction of this Court was Indebted Unto the Same Charles In the Sum of six hundred and twenty five pounds of Tobacco as p the Acco.t thereof will appear and soe thereof being Indebted the said Thomas In Consideration thereof afterwards to witt the same day and Year afd at the County afd and within the afd Jurisdiction Upon himself assumed ^and^ to the said (Charles |
