87 person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as afd to shew Cause if any he she or they have why the same Goods Chattles Rights or Creditts so Attached in his her or Their hands Ought not to be Condemned and Execution thereof had made (according to act of Assembly in such Case made and provided) if to him her or them it shall seem Meet and how you shall Execute this Writt that you make known unto our said Justices at the Day and place afd and have You then and there this Writt Wittness Robert King Gent Chief Justice of Our said Court the Twenty fourth Day of August In the Nineteenth Year of Our Dominion &a Anno Dominie One Thousand Seven Hundred and Thirty Three Att Which said third Tuesday of November to witt the twentieth day of the Same month anno Dom One thousand Seven hundred and thirty three Came the said Woney MccCleamey by Francis Allen his attorney and the sher of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following viz.t By Vertue of the within writt to me directed to the Justices of Somerset County Court I do Certifie that on the fifteenth day of November One thousand Seven hundred and thirty three I did attach of the goods and Chattells of a Certain Charles Reading to the Value of twelve hundred pounds of tobacco and twenty shillings for the Use of Woney MccClemmey in the hands of Robert Geddes and I further Certifie that by John Dennis and Joshua Merrill good and Lawfull men of my Bailywick I have made Known to the said Robert Geddes that he be and appear at the time and place appointed so answers Jas Caldwell sher Whereupon the said Robert Geddes Garrnishe of the afd Charles Redding appears in his proper person and Says that he Cannot gainsay but that he has of the rights and Creditts of the said Charles Redding to the value of One thousand pounds of tobacco nor but that the Same Ought to be Condemned in his hands for the Use of the said Woney MccClemmey as of the rights and Creditts of the said Charles Redding which the plft doth not gainsay Whereupon the afd Woney MccClemmey by his attorney afd prays that upon giveing Security according to act of assembly the afd One thousand pounds of tobacco so as afd Confessed by the afd Robert Geddes Garnishee as afd as of the rights and Creditts of the afd Charles Redding may be Condemned in the hands of the said Robert Geddes towards Satisfying to the said Woney MccClemmey his damages and Costs by means of the Suit afd &a Thereupon a Certain William MccClemmey of Somerset County planter present here in Court undertakes for the said Woney MccClemmey that if in Case the said Charles Redding do at any time within a year and a day appear and make all or any part of the said Woney MccClammeys Claime against him to be Satisfied or Otherwise to be undue before the Laying of the attachment afd that then the said Woney MccClemmey Shall make restitution unto the said Charles Redding of all or Such part thereof as shall be so made appear to be undue as afd or that he the said William Clammey will do the Same for him &a Therefore it is Considered that the said Sum of One thousand pounds of tobacco so as afd Confessed be Condemned in the hands of the said Robert Geddes as of the Rights and Creditts of the said Charles Redding towards Satisfying unto the said Woney MccClemmey as well his damages by occasion of the premisses afd as also all Costs and Charges accrewing by occasion of the attachment afd and that the afd Woney MccClamey have thereof Ex.n Memorand.m The Gar Robert Geddes voluntarily takes his Oath that he hath noe more of the Effects of the defts than what he has Confessed as afd &a |
