1733 87 Shillings and Nine pence Currant mony of Maryland as also 259 pounds of tobacco for his Costs and Charges afd to the Same John at his request by the Court here and Consent of the parties afd adjudged and the afd deft in mercy &a Whereupon at the prayer of the afd John Kendall by his attorney afd is adjudged to give Speciall bail to the action afd thereupon a Certain William Bevins of Somerset County planter present here in Court in his proper person ^undertakes for ye sd Pat Connelly^ that if in Case the said John Kendall should Recover Judgment ^in the plea afd^ against the said Patrick Connelly or that the said Patrick Connelly should be therein Convict that then he the said Patrick Connelly shall pay the Condemnation of the Court thereupon or render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that he the said William Bevins will do the same for him &a
hand Charles C Redin Henry White marke Jos Nichols One the back side of the foregoing note it was thus Endorsed viz August 23.d 1733 Personally appeared before me the Subscriber One of his Lordships Justices for the County of Somerset the Within Named Woney Macclamy and made Oath upon the holy Evangelest of Almighty God that the within Debt is Justly and truly due to him from the within Mentioned Charles Reding the Corn Excepted and that he hath received no part or parcell thereof nor any one for him to the best of his Knowledge more then the said Corn and that the said Charles Reading is run away out of this province as he is Informed proved before me one of his Lordships Justice of the peace for Somerset County the Day and year Above Written Mr Hayward Cha Rackliffe The attachment upon the above Note for Woney MccClamey against Charles Reading Cha Rackliffe To M.r Thomas Hayward These His Lordship the Right Honourable the Lord proprietary of the province of Maryland Commanded the Sher of Somerset County by his writt in these words following viz.t Somerset ss Charles absolute Lord and proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &a To the sher of Somerset County Greeting we Command you that you Attach any of the Goods Chattles Rights or Creditts of Charles Redding Late of Somerset County Planter if they shall be found in your bailywick to the Value ^of^ twelve hundred pounds of tobacco and twenty shillings and when you have the same attached or any part thereof the same In Your Custody safe keep so that you have the Same before our Justices of Our County Court of Somerset to be held at dividing Creek the Third Tuesday of November next then and there to be Condemned According to Act of assembly to and for the Use of a Certain Woney Maccleney Unless the said Charles Reading by himself or his attorney shall appear and Answer unto the said Woney Macclemey in a plea trespass upon the Case &a According to Law and that by Good and Lawfull men of your bailywick you make known unto the (person |
