August Court 1733 75 Justices of our Same Court at Dividing Creek in the County aforesaid by Consideration of the Same Court Recovered against William Hearn late of Somerset County Planter als dict William Hearn of Somerset County in the Province of Maryland Planter as well a Certain Debt of Two thousand Eight hundred seventy and two pounds of Merchantable Tobacco and Casque as three hundred and twenty one pounds of Tob.o which to the same Thomas in our Same Court were Adjudged for his Damages which he had by Occasion of the Detaining of the Same Debt whereof he is Convict as by the Record and proceeding thereof in our Same Court before our Justices at Dividing Creek Remaining manifestly Appeareth Nevertheless Execution of the Judgment afs.d as yet Remaineth to be made and the afs.d Thos Layfield is since dead as by the Insinuation of Cathrine Layfield and George Layfield Executors of the Testament and Last will of The afs.d Thomas we have recd and because we will that those things which in our Same Court are Rightfully Acted Ought to be duly Executed We Command You that by honest and Lawfull men of your Balywick you make known unto the said William Hearn that he be and appear before our Justices of our County Court of Somerset to be held at Dividing Creek the third Tuesday of August next to shew Cause if any thing for himself he hath or to say knoweth wherfore the Aforesaid Cathrine and George should not have their Execution against him of the Debt and Damages afs.d According to the form of the Recovery afs.d if unto him it shall seem Expedient and have you then and there this writt Wittness Robt King Gent ^Chief Justice of our said Court^ the 25.th day of June in the 19.th Year of our Dominion &ca Anno Dom 1733 Att which said third Tuesday of August to witt the twenty first Day of the same Month Anno Dom one thousand seven hundred and thirty three before the Justices of his Lord ps County Court of Somerset held at Dividing Creek in the County afs.d came the afs.d Cathrine Layfield and George Layfield Ex.rs as afores.d by Francis Allen their Attorney afores.d and the Sher of Somerset County to Witt Joshua Caldwell Gent at the same day Returned that he by Virtue of the within writt afs.d to him Directed had made known unto the afs.d William Hearn by John Doe & Richd Roe honest and Lawfull men of his Bailywick that he be and appear before his said Lordships Justices at the day and place afs.d to shew &c.a as within to him it was Commanded and the Same Wm Hearn so forewarned and at the same day being solemnly Called Cometh not but makes Default Therefore it is Considered that the afs.d Cathrine Layfield & George Layfield ^Exrs as afd^ have Execution against the same W.m Hearn of the Debt and Damages afs.d According to the force form and Effect of the Recovery afs.d &c.a
