    of his Balywick that he be and Appear before his said Lordships Justices
    at the day and place afores.d to shew &c.a as within to him it was Command'd
    and the aforesaid Aaron Timmons so forewarned  And at the same day being
    solemnly Called Cometh not but makes Default
                                                                                  Therefore it is Considred
    that the aforesaid Joseph Jones have Execution Against the same
    Aaron Timmons of the Debt and Damages afs.d According to the
    form of the Recognizance Afs.d &ca

County Planter was Attached to Answer unto Sam.l
Reah of a plea of Trespass upon the Case
    And Whereupon the said Samuel by Francis Allen his attorney
    Complains that Whereas the said Rich.d the sixth day of August Anno Dom
    seventeen hundred and thirty one at Som.rst County afs.d within the Jurr of
    this Court was Indebted unto the said Sam.l in Tenn pounds Five shillings
    and four pence half penny Lawfull mony of America for sundry Goods
    wares and Merchandizes by the said Samuel to the said Richd at the
    Special Instance and Request of the Said Rich.d before that time sold
    and Delivered as by Acc.t hereunto annexed may in Court appear
    And being so thereof Indebted the said Rich.d in Consideration thereof
    the day and Year afs.d at the place afs.d upon himself did assume and to
    the said Samuel then and there did faithfully promise that he the said
    Rich.d the said Teen pounds five shills and four pence half penny to the said
    Samuel when he should be afterwards thereunto Requested he would
    well and faithfully pay and Content  And altho the said Rich.d four pounds
    thirteen shillings and Two pence parcell of the afs.d tenn pounds five shill.s
    and four pence half penny to the said Sam.l he hath paid and satisfyed
    yett as to five pounds twelve shillings and Two pence half penny residue
    thereof the said Rich.d his promise and assumption aforesaid in form
    aforesaid made Nothing Regarding but plotting and fraudulently Intending
    the said Sam.l in that part Craftilly and Subtilly to deceive and Defraud
    the said five pounds Twelve Shillings and Two pence half penny to
    the said Samuel altho the same to do the said Rich.d by the said Saml
