53 we will not that you proceed in any of the Causes afd to take life or member but that in every such Case you send the prisoners with their Indictments and the whole matters depending before you to Our Justices of assize nisi prius and Goal delivery at the next Court of Oyer and terminer to be held for our said County be it whensoever and wheresoever to be holden there to be tryed And we Command you and every of you diligently to Intend the keeping the peace acts of assembly Laws Customs and Statutes afd and all and Every the premisses and that at your County Courts you make Inquisition and hear and determine as afd doing therein us to Justice appertaines according to the Laws Customs and directions of the acts of assembly afd so far forth as they provide and where they are scilent according to the Laws Statutes and Reasonable Customs of England as used and practized within this province and further we do Constitute ordain and appoint you the said Charles Calvert John Hall Richard Tilghman Mathew Tilghman Ward, John Rousby, Benjamin Tasker, Philip Lee John Rider Michael Howard George Plater Edmond Jenings, Robert King John Smith William Stoughton John McClester John Handy, James Dashiell, John Scott, James Martin William Lane Thomas Williams Henry Ballard David Wilson Edward Rownd and Charles Rackliffe or any three or more of you as afd to Issue ^out^ writts preceipts process and attachments and hold plea of all actions popular and of all actions personall of what sort soever wherein the demand doth not Exceed the sum One Hundred pounds Sterling or thirty thousand pounds of tobacco and all actions personall now depending before you and after Judgmt Execution to award in all such Cases and Actions afd according to the Laws Customs and directions of the acts of assembly afd so far forth as they provide and where they are Scilent according to the Laws Statutes and Reasonable Customs of England as used and practized within this province in which said actions so to be tryed we do Constitute ordain and appoint you the said Charles Calvert John Hall, Richard Tilghman Mathew Tilghman Ward John Rousby Benjamin Tasker Philip Lee John Rider, Michael Howard George Plater, Edmond Jenings Robert King John Smith William Stoughton John McClester John Handy James Dashiell John Scott James Martin W.m Lane, Thomas Williams Henry Ballard David Wilson Edward Rownd and Charles Rackliffe and none others to be Judges also by these presents we do Command the Sheriffe of Our said County of Somerset that at the Severall Courts to be held of our said County he give his attendance and Cause to Come before you or any three or more of you as afd such and so many good and Lawfull men of his Bailywick out of Each and Every hundred thereof by whom the truth of the matter in the premisses may be ^the^ better known and Enquired of Lastly you shall Cause to be brought before you at your said Courts all writts preceipts process and Indictments to your Courts & Jurisdictions belonging that the same may be Inspected and by due Course of Law determined Wittness Our Trusty and well Beloved Samuel Ogle Esqr Leiutennant Generall and Cheife Governour |
