1733 4 And that thereof he should not fail &c.a Whereupon the said Robt Bolton by Francis Allen his Attorney Complains against the aforesaid Robt Holland in the plea aforesd as follows vizt Somerset County ss Robt Holland late of Somerset County Mercht was Attached to Answer unto Robt Bolton of a plea of Trespass upon the Case &ca And Whereupon the Said Rob.t Bolton by Francis Allen his Attorney Complains that Whereas the Said Rob.t Holland the thirtieth Day of March Anno Dom Seventeen hundred and thirty three at the County of Somerset afsd within the Jurr of this Court was Indebted unto the Said Rob.t Bolton in one hundred fifty one pounds seventeen shillings and two pence half penny Currt Mony of Maryland for sundrys properly Chargeable in Acc.t as by Acc.t thereof hereunto annexed may in Court appear and being so thereof Indebted the said Rob.t Holland in Consideration thereof the day and year aforesaid at the place aforesaid upon himself Did assume and to the said Rob.t Bolton then and there did faithfully Promise that he the said Rob.t Holland the said one hundred fifty one pounds seventeen shillings and Two pence half penny to the said Rob.t Bolton when he should be afterwards thereunto Requested he would well and faithfully pay and Content and Altho the said Rob.t Holland fifty Eight pounds & sixpence half penny parcel of ye aforesaid one hundred and fifty one pounds seventeen shillings and two pence half penny to the said Robt Bolton he hath paid and satisfyed yet as to Ninety three pounds sixteen shill.s and Eight pence Residue of the aforesaid one hundred and fifty one pounds seventeen shillings and two pence half penny the said Rob.t Holland his promise and assumption aforesaid in form aforesaid made Nothing Regarding but plotting and fraudulently Intending the said Rob.t Bolton in that part Craftily & Subtilly to deceive and Defraud the said Ninety three pounds sixteen shills and Eight pence to the said Rob.t Bolton Altho the Same to do the said Rob.t Holland by the aforesaid Rob.t Bolton on the aforesaid thirtieth Day of March in the Year aforesaid and often afterwards at Somerset County within the Jurr aforesaid he was thereunto Requested hath not paid or Contented but the Same to him hitherto to pay or Content hath Refused and still doth Refuse and Deny And Whereas also the aforesaid Rob.t Holland afterwards to witt the aforesaid thirtieth day of March in the Year aforesaid at the County afs.d within the Jurr aforesaid was Indebted unto the Said Rob.t Bolton in Nine pounds Nineteen Shill.s and six pence Like Mony for so much by the said Rob.t Bolton for the said Rob.t Holland at the Special Instance and Request of the said Rob.t Holland To Thomas Lawrence Esq.r Deposited & paid And being so thereof Indebted the said Rob.t Holland afterwards to Witt the day and Year aforesaid at the place aforesaid upon himself Did Assume and to the said Robt Bolton then and there did faithfully promise that he the said Rob.t Holland the said Nine pounds Nineteen Shill.s and Six pence to the said Rob.t Bolton when he should be thereunto Requested |
