46 Att which said next Court to witt the Twentieth day of June Ann.o Dom One thousand seven hundred & thirty two Came againe as well the afd John Caldwell procheinamy of the same Tunstall Hack ^as the^ afd William Wye by his attorney afd and Thereupon the said William Wye prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the afd John Caldwell procheinamy as afd here also &a Att which said next Court to witt the fifteenth day of August Anno Dom One thousand Seven hundred and thirty two Came againe as well the afd John Caldwell procheinamy of the same Tunstall Hack as the afd William Wye by his attorney afd and thereupon the same William Wye prays further LEave thereof to Imparle here until next Court and he hath it and the same day is Given in to the afd John Caldwell procheinamy as afd here also &a Att which said next Court to witt the twenty first day of November anno Dom One thousand seven hundred and thirty two Came againe as well the afd John Caldwell procheinamy of the same Tunstall Hack as the afd William Wye by his attorney afd and thereupon the same William Wye prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the afd John Caldwell procheinamy as afd here also &.a Att which said next Court to witt the nineteenth day of June anno Dom One thousand Seven hundred and thirty three Came again as well the afd John Caldwell procheinamy of the Same Tunstall Hack as the afd William Wye by his attorney afd and thereupon the Same William as before defends the force and Injury when &a and saith that he doth not detain the Negros in the declaration afd Contained in manner and form as the afd Tunstall above against him hath Complained and thereof he puts himself upon the Country &.a and the plantife in Like manner Thereupon it is Commanded the sher of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordships Court of Somerset now in Court Judicially sitting at dividing Creek twelve &.a by whom &.a and who neither &.a to Recognize &.a because as well &.a and ^afterwards^ Immediately ^came^ thereof the Jury &.a and the Jurors of that Same Jury by Joshua Caldwell Gent sherrife of the County afd to this Impannelled being Called Came (to witt) Edward Rownd Michael Disharoon, John Webb Edward Beachamp Joshua Sturges Hutton Hill John Johnson David Huttson William Macclemy David Hazzard Mathew Purnall ^&^ John Brown who to say the truth and again the premisses being Elected tryed and Sworn upon their Oath did find that Spencer Hack father of Tunstall Hack the |
