42 Witness our hand the day and year abovesaid And furder the said Bounder stands about two hundred and fifty yards above the Mouth of Broad Branch Thomas Humphrys (seal) Jno Records Senr (seal) Somerset sst Febry ye 3d 1729/30 The Deposition of Robt Givan Senr aged about fifty Nine Years being sworn on the Holy Evangelist of Almighty God Deposeth and Sayth that about Twenty years ago he was in Company with James Givan and James Caldwell Senr up broad Branch and they Show'd him a Marked White Oak about a quarter of a Mile above ye old Road that Leads from James Givans's to James Caldwells being on the East side of said Branch as he Remembers which this Deponant always understood that the Said White Oak where he now stands with hand on the same was the first bounder of Wm Manlives hand partly then in the possession of Said Caldwell and this Deponant furder sayth in Relation to another bounder on the South side of the Main branch of Rewastico that about thirty years ago Tho.s Ackworth Deceased told this Deponant that this White Oak whereon he now hath his hand was a bounder of his Land and that it Divided his Land from W.m Manlives land & was also Manlives Bounder and this Deponant furder sayeth that James Caldwell said severall years before he Died Brought this Deponant to the ^s.d^ white oak & he this Deponant Runn Severall of the Lines of the within Mentioned Land he sd Caldwell having the Possession & made Purchase of part of the said Tract and furder sayeth not/ Sworn before us the Day and Year aforesaid Thos Humphrys Jno Reccords Senr Somersett County ss Febry ye 3d Day 1729/30 The Deposition of Abraham Taylor aged about thirty one years being sworn on the Holy Evangelist of Almighty God Deposeth and sayeth that about Nine Years ago Richd Ackworth Senr now Deces'd show'd this Deponant this Marked white oak that he hath his hand now upon and told him that it was the second bounder of his Land Called Weatherlys Contrivance of three hundred acres part whereof the said Ackworth sold to this Deponant and Likewise show'd this Deponant a Marked white Oak about Twenty four yards to the South East of Said Bounder which he said was Jn.o Lamais Bounder and this Deponant furder saith that the said Ackworth Came from said Bounder with him down broad branch to the Main Branch where stood a Markt white oak & a old Slipt white Oak where this Deponant now stands with his hand on the said White Oak and being on Horseback pointed to the said white oaks & told him yt white oak was his bounder but which of the Two this Deponant Cannot tell ye said Oaks being Nigh together and furder sayeth not Sworn before us the Day and Year afs.d Thomas Humphreys John Reccords Senr
