June Court 1733 (41) Require you or any three or two of you at some time and place as to you or any three or two of you shall seem Convenient you meet on the afsd Land first Choice (you first having taken your Oaths on the Holy Evangelist of Almighty God According to Act of Assembly in Such Case made and provided) and there Cause to Come before you or any three or two of you all Such Evidences as shall be to you or any three or two of you Nominated by the said Complainant (or Def.t if any) and that you Examine them upon their Corporall Oaths to be by you or any three or two of you Administred on the Holy Evangelist of Almighty God in the presents of the said Complainant (or Def.t if any) touching the Truth or Remembrance of their Knowledge or any thing that may Relate to the Cause afs.d and that Reducing the Several Depositions into writing you send the same together with this our Commissn under you or any three or two of your hands to us to our County Court of Somerset with all Convenient Speed Wittness W.m Planner Gent one of our Justices of the said Court the Nineteenth day of November in the thirteenth Year of our Dom.n &c Anno Dom one thousand seven hundred and Twenty Nine On the backside of the foregoing Comiss.n it was Endorsed as followeth vizt M.r John Handy & M.r Thomas Humphries and John Records sworn before me According to Law this first Day of January 1730 Jno Caldwell Likewise to the Same Commission were Annexed the following Affidavatts vizt Somerset ss Febry ye 3.d 1729/30 By Virtue of his Lordships Comiss.n directed to us the subscribers by the Justices of said County here unto Annexed we do Certifye that we did set up our Notes under hand in severall publick Places in full time before we meet as the Law Directs and having somoned Rob.t Givans Senr and Abram Taylor they show'd us an old marked white Oak standing on the East side of Branch Coming out of Rowastico Branch Called broad branch about seventy five yards above the Road that Leads from Weatherlies Mill To Thos Langford there being a Corner Tree about Twenty four Yards to the South East thereof which is allowed to be a Bounder of John Lamies Land and the said Evidences Laying their hands on the said Tree Declared as by the Depositions hereunto Annexed doth appear after which the said Taylor and Given Carried us to the South side of the Main branch of Rewastico Creek and show.d us an old markt white oak Close by the Branch side about six yards to the North West of an old white oak being slipt fourways & hollow and the said bounder was Remark't before us by James Caldwell and he also Marked a Pine saplin with twelve Notches about two yards Distance from said white Oak and the said Givans and Taylor laying their hand on the said White Oak declared as by their Depositions hereunto Annexed will appear as Witness |
