here to witt the Ninteenth day of November Ann Dom One thousand Seven hundred and twenty Eight before the worshipfull Samuel Hopkins Gent and his associates the then Justices of our said Court at dividing Creek in the County af.d by Consideration of the same Court recovered against Elizabeth Dashiell late of Somerset County widow Administratrix of all and Singular the goods and Chattles rights and Creditts which were of Christopher Dashiell at the time of his death twenty Eight pounds one Shilling and three pence three farthings to be paid in Corn and pork at Country price) and four hundred and thirty nine pounds of Tobacco for his damages which he Sustained as well by Occasion of the Non performance of a Certain promise and assumption to the same Adam by the af.d Christopher in his Life time made as for his Costs and Charges by him about his suit in that part apposed to be Levied of the goods and Chattles which were of the af.d Christopher Dashiell in the hands of the af.d Elizabeth to be administred if so much in her hands she hath and if so much in her hands she hath not than the costs af.d to be levied of the proper goods and Chattles of the af.d Elizabeth whereof she is Convict as by the record and process thereof in our Same Court before our Justices at dividing Creek in the County aforesaid remaining manifestly appeareth afterwards the af.d Elizabeth Dashiell took to her husband a certain Walter Jacobs as by the Insinuation of the af.d Adam in our Court before us at dividing Creek in the County af.d we have received which same Walter Jacobs afterwards in the County af.d died as in our Court af.d we have received and altho Judgment be thereof rendered Nevertheless of the af.d Adam we have received and because we will that those things which in our same Court are rightfully acted ought to be duly Executed we Command you that by honest and Lawfull men of your bailywick you make known unto the af.d Elizabeth Jacobs that she be before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of November next to shew cause if any thing for her self she hath or to say knoweth wherefore the af.d Adam Muir his Execution against her for the damages af.d of the goods and Chattles which were of the af.d Christopher Dashiell at the time of his death in the hands of the af.d Elizabeth Jacobs to be administred if so much in her hands she hath and if so much in her hands she hath not that the costs af.d to be levied of the proper goods and Chattles of the af.d Elizabeth Jacobs) to have ought not according to the form of the recovery af.d if to her it shall seem Expedient and have you then and there the names of those by whome to her you make the same known and this writt wittness Robert King Gent Chief Justice afores.d Court the 23.d of fry next the 29th [illegible] (of our |
