(270) should have then and there the names of them by whom to him he should make the same known and that writt at which said third tuesday of June to witt the Sixteenth day of the same month Ann Dom One thousand Seven hundred and thirty being the return of the said writt Came y.e s.d Thomas Dashiell by his then attorney and the then Sher of Somerset County (to witt) John Purnall Gent at the same day returned that he by vertue of y.e writt afores.d to him directed had made known to the afores.d Randall West by Hugh Porter and John Doe honest and lawfull men of his bailywick that he should be before the then Justices of his said Lordships County Court of Somerset at the day and place afores.d to shew &.a as to him it was Commanded and the afores.d Randall West so fore warned and at y.e same day solemnly called did not come but made default by which then in the same Court before & by y.e Justices thereof it was Considered that the aforesaid Thomas Dashiell should have his Execution against the aforesaid Randall West of the damages afores.d according to the force and form and Effect of the Recognizance afores.d also that the sd Thomas Dashiell according to the form of the statute in such Case lately made and provided should recover against the afores.d Randall West two hundred and fifty four pounds of tobacco for his Costs Charges and damages which he sustained by Occasion of the delay of Execution of the damages afores.d &.a as by the Records thereof in his s.d Lordships County Court of Somerset at dividing Creek afores.d before the Justices of y.e same Court remaining Manifestly Appeareth which same Thomas Execution thereof as yet hath not followed whereby action did accrew unto the same Thomas to demand and have from the s.d Randall West in his Life ^time^ y.e afores.d fourteen hundred and Ninty four pounds of tobacco Nevertheless the afores.d Randall West in his life time and the afores.d Randall Revell after y.e death of the afores.d Randall West altho' often required the aforesaid fourteen hundred and Ninty four pounds of tobacco unto the s.d Thomas hath not paid but the same to him hitherto to pay the afores.d Randall West in his life time and the afores.d Randall Revell after the death of the s.d Randall West altogether hath refused and the same unto the said Thomas still to pay the aforesaid Randall Revell doth deny and unjustly detain to y.e damage of y.e s.d Thomas two thousand pounds of Tobacco and thereof he bringeth Suit &.a Pledges &.a John Doe & Rich.d Roe And the aforesaid Randall Revell Executor of the said Randall West by William Beckingham his attorney Comes and defends the force and Injury when &a and prays Leave to Imparle hereuntill next Court and he hath it and the Same day is given to the afd Thomas here also &a Att which said next Court to witt the eighteenth day of June Anno Dom One thousand Seven hundred and thirty four Came againe as well the afd Thomas Dashiell as the aforesaid Randall Revell by their attorneys afd And whereupon the Same Randall Revell prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd Thomas Dashiell here also &a Att which said next Court to witt the Twentieth day of August Anno Dom One thousand seven hundred and thirty four Came againe as well the afd Thomas Dashiell as the afores.d Randall Revell by their attorneys afd and whereupon the same Randall prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd Thomas here also &a Att |
